2.2 DASR: The Direct Access Service Request provided by AUN to Southern California <br />Edison Company. <br />2.3 Firm: "Firm" shall mean, with respect to this Agreement, that the only excuse for non- <br />delivery of the energy available under this Agreement shall be the existence of an <br />Uncontrollable Force as defined in Article XIII, Section 13.2. <br />2.4 Interest Rate: Any payment of interest required by this agreement shall be at the rate of <br />five (5) percent per year. <br />2.5 Operating Representative: The person designated by a Party pursuant to the provisions <br />of Article VIII hereof. <br />2.6 SET: Sempra Energy Trading, a California Independent System Operator (ISO) certified <br />Scheduling Coordinator. <br />ARTICLE III <br />POINTS OF DELIVERY <br />3.1 The Point of Delivery for the electrical energy supplied hereunder shall be the South Path <br />15 Zone as defined by the ISO. <br />3.2 Other additional points of delivery may be mutually agreed upon from time to time by the <br />Parties in accordance with procedures established by the Operating Representatives. <br />ARTICLE IV <br />SERVICES TO BE RENDERED <br />4.1 Pursuant to the terms and conditions of this Agreement, Colton agrees to sell firm electrical <br />energy to AUN in amounts of zero (0) Kilowatts up to and including 500 Kilowatts per <br />hour in increments of 100 Kilowatts for all hours during the term of the Agreement. <br />Page 3 of 16 <br />Power Sales Agreement <br />Colton and American Utility Network <br />
