WARD <br />STRATEGIC CLAIMS SOLUTIONS <br />May 27, 1999 <br />Jose Luis Gonzalez <br />670 East "F" Street <br />Colton, CA 92324 <br />RE: Our Client: City of Colton <br />Claimant: Jose Luis Gonzalez <br />Date of Loss: April 3, 1999 <br />Dear Mr. Gonzalez: <br />Our investigation into the circumstances surrounding the claim you recently presented to the City <br />has been completed. <br />City reports that on April 3, 1999, a City employee responded to 670 East "F" Street. The <br />_..ployee found a broken neutral conductor at the weather head and repaired it. The cause of the <br />u, eak was unknown. <br />This type of occurrence can be found described in Customer Service Policy #8, Interruptions or <br />Defects in Service. It states: <br />"The City shall not be liable on account of interruptions to service or by reason of any claim for loss <br />or damages resulting therefrom caused by uncontrollable forces, the term "uncontrollable forces" <br />being deemed for the purposes of these customer service policies to mean flood, earthquake, storm, <br />lightning, fire, epidemic, failure3f fa .ili i s, war, riot, civil disturbances, labor disturbances, restraint <br />by court or public authority, or any like cause beyond the control of the City.
