3 <br />4 <br />9 <br />C <br />7 <br />with a lighting efficiency project that will require a total <br />investment of $92,009. <br />Colton's cost share contribution to this project is $25,000 and <br />will be paid directly to Energy Masters for application to the <br />total project cost. The customer's net expense for the project <br />will thus be $67,009. <br />Terms <br />The City will make full payment of $25,000 in incentive funding <br />to Energy Masters within 30 days of the approval of this <br />Agreement. <br />Release of News Information <br />No news release, including photographs, public announcements or <br />confirmation of same, of any part of the subject matter of this <br />Agreement or any phase of any program hereunder shall be made <br />without prior written approval of the City Manager or his/her <br />designee. <br />Energy Masters shall keep confidential all reports, information <br />and data received, prepared or assembled pursuant to performance <br />hereunder and that the City designates as confidential. Such <br />information shall not be made available to any person, firm, <br />corporation or entity without the prior written consent of the <br />City. <br />The City or any of its duly authorized representatives shall have <br />access to any books, documents, papers and records of Energy <br />Masters and/or its subcontractors which are pertinent to the <br />specific program hereunder for the purpose of making an audit, an <br />examination, excerpts and transcriptions. All books, records and <br />supporting detail shall be retained for a period of five (5) <br />years after the expiration of the term of this Agreement, or any <br />extension thereof, or for any longer period of time as required <br />by law. <br />Energy Masters agrees that in the event the program established <br />2 <br />
