(d) Determine eligibility for and make timely payments of, valid claims for <br />compensation, medical and rehabilitation benefits, and other required <br />benefits under applicable Workers' Compensation insurance laws, <br />together with all allocated claim services as referenced in Section 4.3 of <br />this AGREEMENT. <br />(e) Engage and supervise the services of persons or firms outside its <br />organization for work in connection with claims requiring legal or <br />rehabilitation services. <br />(f) Maintain an accurate and complete file on each reported claim which <br />shall be available during normal business hours for inspection by the <br />CLIENT, its representatives or by appropriate regulatory authorities. <br />(g) Protect any subrogation rights to the CLIENT which may arise upon <br />Payment of claims and notify the CLIENT of any such rights which may <br />be available to the CLIENT. <br />II. OTHER SERVICE PROVISIONS OF TRISTAR <br />2.1 Monitor all medical treatment associated with claims for appropriateness of <br />medical treatment and relatedness of such treatment to the compensable injury. <br />2.2 Review and make recommendations to the CLIENT, as necessary, on the use of <br />in-house medical experts. <br />2.3 Authorize examinations as required to determine the nature and extent of <br />disabling injuries. <br />2.4 Provide guidance to the CLIENT with respect to any physical limitations and/or <br />restrictions which may arise due to injuries and which may impact return to <br />work activities. <br />2.5 Investigate or arrange for investigation of questionable claims as necessary. <br />2.6 Provide information and guidance to the CLIENT as required, or requested, <br />regarding Workers' Compensation benefits, injuries and permanent disability <br />ratings. <br />2.7- Provide the CLIENT with information updating the status of individual claims, <br />including periodic meetings to discuss losses. <br />2.8 Submit monthly loss statistical and/or narrative reports to the CLIENT. <br />
