1 <br />8.1.2 To establish procedures and practices as to determinations of costs <br />2 <br />and expenses and energy losses in connection with transactions hereunder; <br />3 <br />8.1.3 To establish detailed arrangements for scheduling, communication <br />4 <br />and implementation of operating procedures; <br />5 <br />8.1.4 With respect to Colton, to ask for and receive copies of AUN <br />6 <br />documentation pertaining to its activities as an energy service provider <br />7 <br />during the term of this agreement. <br />8 <br />8.1.5 To do such other things as are provided for herein, provided that the <br />9 <br />Operating Representatives shall have no authority to modify any of the <br />10 <br />provisions of this Agreement. <br />11 <br />ARTICLE IX <br />12 EFFECT OF SECTION HEADINGS <br />13 Section headings appearing in this Agreement are inserted for convenience only <br />14 and shall not be construed as interpretation of text. <br />15 <br />ARTICLE X <br />17 NON -DEDICATION OF FACILITIES <br />18 Any undertaking by one Party to the other Parties under any provision of this <br />19 Agreement shall not constitute the dedication of the system or any portion thereof of <br />20 either Party to the public, a third party, or to the other Parties, and it is understood and <br />21 agreed that any such undertaking by any Party shall cease upon the termination of this <br />22 Agreement. <br />23 <br />24 <br />Power Sales Agreement, City of Colton and American Utility Network June 8, 1999 Page 6 of 18 <br />
