Garcia, City Manager'�:P, <br />FROM: Patrick G C Chief of Police <br />SUBJECT: Booking Fees Adopt Resolution <br />DATE: March 11, 1999 <br />BACKGROUND: The Criminal Justice Administrative Fee (booking fee) was enacted in 1990 in <br />an effort to help mitigate the impact of the State's elimination of $431 million of support to <br />counties. San Bernardino County adopted the booking fee which became the subject of extensive <br />litigation. Colton, along with almost every city in the County, participated in the litigation. As a <br />result, the City signed a "Settlement Agreement" with the County which calls for an annual fee <br />increase based upon the Consumer Price index (CPI) to be implemented on February 11' of each <br />year until 2000. <br />DISCUSSION/ANALYSIS: Recently cities joined forces and requested the County board of <br />Supervisors to repeal the booking fees. The request was denied based on financial hardship since <br />booking fees generate $4 million annually. As a result, County Staff, city Managers, and Police <br />Chiefs met to discuss alternatives to mitigate booking fees and their impact on individual cities. <br />They determined that this would be an ongoing process to identify mutually agreeable alternatives <br />to reducing the booking fee. One of the first steps the group identified was the elimination of the <br />CPI increase that was due in February, and that any savings a city realized would be allocated to <br />local law enforcement programs. <br />Since Colton signed the original settlement agreement, the City must now sign the "Supplemental <br />Agreement eliminating February 11, 1999, Criminal Justice Administrative Fee Increase". This <br />supplemental agreement must be signed by April 1, 1999, or the City will pay the increased <br />booking fee. Almost every city within the County is requesting their City Council to sign the <br />agreement. City staff who have attended meetings relative to booking fee reductions concur and <br />recommend that the City enter into the supplemental agreement. <br />Booking/rw <br />
