R-29-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, CALIFORNIA, ADOPTING THE SUPPLEMENTAL AGREEMENT BETWEEN THE COUNTY OF SAN BERNARDINO AND THE CITY OF COLTON ELIMINATING THE FEBRUARY 11, 1999 CRIMINAL JUSTICE ADMINISTRATIVE FEE INCREASE WHEREAS, the Criminal Justice Administrative Fee (booking fee) was enacted to help mitigate the impact of the State's $431 million reduction of support to counties in 1990, and since being enacted has been the subject of extensive litigation in which Colton has participated along with other cities in the County; and, WHEREAS, Colton and other cities have signed a booking fee settlement agreement with the County and these settlement agreements call for an annual fee increase based upon the Consumer Price Index (CPI) to be implemented on February 1 l'hof each year through the year 2000; and, WHEREAS, Colton recently joined with other cities in the County to ask the County Board of Supervisors to repeal booking fees; and, WHEREAS, the County board of Supervisors denied the request to repeal booking fees citing that it would create a financial hardship for the county since the fee generates approximately $4 million annually; and, WHEREAS, a meeting was held between county staff, city managers, and police chiefs where it was agreed that alternatives would be explored for mitigating booking fees while ensuring the roll back is revenue neutral to the County; and, WHEREAS, waiving the Consumer Price Index (CPI) for one year is a first step in what will be an ongoing process to identify mutually agreeable alternatives to reducing the booking fee; and, WHEREAS, cities who receive the fee reduction will have agreed to allocate to local law enforcement programs the entire amount of their savings derived from the fee reduction; and, I
