Phase 11 would, in <br />general, consist of the planning, design, and construction of the storm drain from Valley <br />Boulevard southerly to the Santa Ana River, including necessary environmental work, right-of- <br />way acquisition, utility relocations, etc. <br />Your Council's action of January 5, approved a language amendment to Section 2.13 of the <br />existing Memorandum of Understanding (MOU), between the County and the City, County <br />Contract No. 95-590, dated June 27, 1995. The language amendment stated, "Colton will only <br />be required to reimburse the County for those portions of the project that would normally be <br />funded by development fees collected by the City of Colton", and "The portion of the project <br />funded by the County will immediately be encumbered upon approval of this Amendment to <br />begin additional pre -design, environmental, and right-of-way acquisition work to get this <br />project moving forward". We will incorporate these recommendations into a draft amendment <br />to the MOU and will target the Board's agenda for March 16, 1999 to consider the revised <br />document. <br />At present, I believe we all understand that the available funding is limited to the amounts of <br />$1,500,000 and $400,000 identified in the existing MOU and are not adequate to complete the <br />project which has been estimated to cost approximately $10 million. Also, that we will <br />continue to work together to identify other funding sources to enable the project to be <br />completed including possible funds from Caltrans, an existing Community Facility District, the <br />Redevelopment Agency, etc. It would appear that the existing funding will be more than <br />adequate to perform all of the pre -design and design work as identified by the Arrowhead <br />Management Group. <br />The existing MOU identifies the City as the lead for the project work. We would like to propose <br />one change in this area. As the County's Flood Control District will be accepting the <br />completed storm drain into its system of operated and maintained facilities, we would prefer to <br />- handle the duties of contract administration and quality assurance for the construction phase <br />of the project and will provide appropriate MOU language to address this. <br />i a <br />
