CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF OCTOBER 5, 1999 <br />TO: Honorable Mayor and City Council <br />APPROVAL: Henry .Garcia, C' Manager�� <br />FROM: av a <br />Community D ent Director <br />SUBJECT: An Ordinance of the City of Colton Amending Section 18.58.070(A) of <br />the Colton Municipal Code Relating to the Expiration of Conditional Use <br />Permits and Variances. <br />DATE: September 27, 1999 <br />BACKGROUND: <br />The City's present Ordinance does not have provisions or procedures for the extension of <br />approved Conditional Use Permits and Variances. Due to this, staff and legal counsel are <br />requesting that Council consider the adoption of the attached Ordinance. <br />DISCUSSION/ANALYSIS: <br />The attached Ordinance provides that all Conditional Use Permits and Variances will be <br />automatically extended for a maximum of four (4) one-year periods, unless it can be shown <br />that the project is not encumbered by a lawsuit, and no substantial work has commenced or <br />financing for the project has not been secured. <br />In essence, a project that is the subject of a lawsuit may be granted up to four (4) one-year <br />extensions upon written application by the applicant. <br />ALTERNATIVES: <br />If Council chooses not to approve the proposed amendment, any Variance or Conditional <br />Use Permit granted by the Planning Commission will continue to become null and void if not <br />exercised within the time specified in such Permit or Variance, or if no date is specified, <br />within one-year from the date of approval thereof. <br />FINANCIAL IMPACT: <br />None. <br />M911111 101211YA ment Director <br />Item #1 <br />
