To approve the Appeal and remove the three Conditions of Approval (Items <br />Miscellaneous No. 10, Grading No. 4, and City Engineer No. 5) as requested. <br />2. Deny the Appeal. <br />FINANCIAL IMPACT: <br />There may be costs (unknown) to the City if the three Conditions of Approval are removed. <br />U.S. Fish and Wildlife Services (USFWS) or any other environmentally concerned entity that <br />may file an injunction against the applicant and/or the City to prevent the proposed project <br />from moving forward until there is a settlement regarding Endangered Species, including but <br />not limited to the Delhi Sands Flower Loving Fly. This action may result in legal expenses. <br />David . Zamora <br />Community Develo ent Director <br />ENVIRONMENTAL IMPACT: <br />There is the potential for impacts to endangered species if mitigation measures outlined in <br />the Conditions of Approval and Mitigation Monitoring Reporting Program are not adhered to. <br />RECOMMENDATION: <br />Staff recommends denial of the Appeal for File Index Number D-39-99 <br />Terminals/Vanir Development for the removal of conditions Miscellaneous <br />No. 4, and City Engineer No. 5 from the Conditions of Approval and <br />Number R- -99, denying the appeal. <br />Report prepared by Lisa R.
