Garcia, City Manager�q , E< /f FROM: City Attorney SUBJECT: Ordinance amending Chapter 5.32 of the Colton Municipal Code relating to the issuance of permits for public dances and dance halls. DATE: October 5, 1999 BACKGROUND: On June 8, 1999, the City Council, directed staff and the City Attorney's office to revise the City's dance permit regulations. The City Council was concerned that the City's right to attach conditions to dance permits was not explicitly stated in the ordinance. The City Council also requested that other provisions be updated to comport with the City's current regulatory practices and to ensure that all provisions were gender neutral. The City Attorney's office, in consultation with the Police and Community Development Departments, have revised the dance permit regulations in their entirety. The revised ordinance features the following: 1. Places responsibility for approval of dance permit applications with the Chief of Police after conducting an investigation of the owner, operator or any person having management or supervision responsibilities. 2. Authorizes the Chief of Police to grant a dance permit upon finding that: • The operation will comply with all applicable laws, including the City's building, fire, zoning and health regulations; • The applicant has not been convicted of specified crimes during the past five years, nor is required to register as a drug or sex offender; • The applicant has not lied on the application; RVPUB\MXM\529595 Item #3
