Garcia, City Manager�q , E< /f <br />FROM: City Attorney <br />SUBJECT: Ordinance amending Chapter 5.32 of the Colton Municipal Code <br />relating to the issuance of permits for public dances and dance <br />halls. <br />DATE: October 5, 1999 <br />BACKGROUND: <br />On June 8, 1999, the City Council, directed staff and the City Attorney's office to revise <br />the City's dance permit regulations. The City Council was concerned that the City's <br />right to attach conditions to dance permits was not explicitly stated in the ordinance. <br />The City Council also requested that other provisions be updated to comport with the <br />City's current regulatory practices and to ensure that all provisions were gender neutral. <br />The City Attorney's office, in consultation with the Police and Community Development <br />Departments, have revised the dance permit regulations in their entirety. The revised <br />ordinance features the following: <br />1. Places responsibility for approval of dance permit applications with the Chief of <br />Police after conducting an investigation of the owner, operator or any person having <br />management or supervision responsibilities. <br />2. Authorizes the Chief of Police to grant a dance permit upon finding that: <br />• The operation will comply with all applicable laws, including the City's <br />building, fire, zoning and health regulations; <br />• The applicant has not been convicted of specified crimes during the past <br />five years, nor is required to register as a drug or sex offender; <br />• The applicant has not lied on the application; <br />RVPUB\MXM\529595 <br />Item #3 <br />
