CLARKE, UTILITY DIRECTOR \ <br />SUBJECT: ADOPTION OF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />EXHORTING THE CARLSBAD OFFICE OF THE U.S. FISH AND WILDLIFE SERVICE <br />FOR FAILURE TO NEGOTIATE AN ACCEPTABLE MITIGATION OF THE COLTON <br />RECOVERY ZONE FOR THE DELHI SANDS FLOWER -LOVING FLY <br />DATE: September 23, 1999 <br />BACKGROUND <br />For close to three years, the City of Colton has been dealing with the U.S. Fish and Wildlife Service in an <br />attempt to bring about a mitigation plan which would allow for the development of property within the City <br />that is impacted by the existence of the Delhi Sands Flower -loving Fly, an endangered species under the <br />protection of the Endangered Species Act. <br />DISCUSSION/ANALYSIS <br />The existence of the Fly in Colton has slowed, and in some cases, halted the development of the West <br />Side of Colton. This absence of aggressive development during a time of economic boom within the <br />Inland Empire region has resulted in financial harm to the City of Colton and its residents. Numerous <br />efforts have been made by City staff and various consultants to effectuate a compromise that would allow <br />the City to grow and at the same time provide for the long-term recovery of the Fly. To date, no <br />compromise has been struck. This failure can only be attributed to the unyielding demands for land and <br />endowment funds on the part of the Service. <br />At the September 7, 1999, meeting of the Colton City Council, direction was given to draft resolutions <br />admonishing the Service for their failure to bring closure to this matter, and to urge the U.S. Congress to <br />undertake a modification to act to delist the Fly. <br />FINANCIAL IMPACT <br />None. <br />RECOMMENDATION <br />That the City Council adopts the attached resolution reflecting the City's concerns regarding the Delhi <br />Sands Flower -loving Fly, and exhorting the Carlsbad office of the U.S. Fish and Wildlife Service for failure <br />to negotiate an acceptable mitigation of the Colton Recovery Zone for the Fly. <br />Page 1 of 1 (w/attachment) Item #18 <br />
