Garcia, <br />FROM: <br />Development Director <br />SUBJECT: Appeal to the City Council Regarding the Planning Commission's Decision to <br />Deny File Index Number DT -28-99, a Request for Approval of Tentative Tract <br />16019 and Amendment to the Environmental Assessment for File Index <br />Number DZ -09-99, and a Zone Change From R-1 (Low Density Residential) to <br />R-1/PC Planned Community and Negative Declaration for File Index Number <br />DZ -09-99. <br />DATE: August 24, 1999 <br />BACKGROUND: <br />On July 27, 1999, the Planning Commission considered and denied a request from Mr. John <br />Reichel, for Tentative Tract Approval and Amendment to the Environmental Assessment for File <br />Index Number DZ -09-99, and a Zone Change from R-1 Low Density Residential to R-1/PC Planned <br />Community, and Environmental Determination, for File Index Number DZ -09-99. <br />After receiving public testimony, the Commission considered and denied the applicant's requests. <br />Attached are the Minutes of the Planning Commission Meeting of July 27, 1999 (Attachment A). <br />Upon denial by the Planning Commission, the applicant was informed of the ten-day appeal period. <br />On August 5, 1999, the applicant filed an official appeal (Attachment B) of the Commission's denial <br />of Tentative Tract 16019, a 52 -lot subdivision, on approximately 10.94 acres, and the Amendment to <br />the Environmental Assessment for File Index DZ -09-99. The Zone change did not require an Appeal <br />to the City Council since the final decision for all Zone Changes rests with the Council, following <br />Planning Commission action/recommendation. <br />DISCUSSION/ANALYSIS: <br />Attached for the Council's review is a copy of the Staff Report (Attachment C) which provided Staff's <br />analysis of the proposed projects at the Commission hearing. As noted in the report, under Project <br />Description, the proposed lot sizes would range from 4,200 square feet to 4,512 square feet. Under <br />the section, Zoning Consistency, the minimum lot size for R-1 lots is 7,200 square feet. The Zone <br />Change, if approved, would allow the PC overlay and lots smaller than 7,200 square feet, also <br />allowing approval of the Tentative Tract. <br />After receiving public testimony, the Planning Commission determined that the density of the <br />proposed Tract was not consistent with the area. They believed it would have an undesirable impact <br />to traffic, and to the surrounding residential (R-1) properties because of the higher concentration of <br />parcels proposed in Tentative Tract 16019, than what is typical of the R-1 designation. Since <br />Tentative Tract 16019 and the Zone Change were both denied by the Planning Commission, the <br />applicant is appealing and requesting that application for the Zone Change and Tentative Tract <br />16019 be approved by the City Council, along with the Negative Declaration for both applications. <br />Item #1 <br />
