R-81-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, UPHOLDING THE PLANNING COMMISSION'S RECOMMENDATION TO DENY FILE INDEX NO. DZ -09-99 (ZONE CHANGE FROM R-1 TO R- 1/PC) AND THE PLANNING COMMISSION'S DECISION TO DENY FILE INDEX NO. DT -28-99 (TENTATIVE TRACT MAP NO. 16019) WHEREAS, the Planning Commission of the City of Colton did hold a Public Hearing on July 27, 1999 for File Index No. DZ -09-99, a request to consider a change of zone from R-1 (Single Family Residential) to R-1/PC (Single Family Residential Planned Community), and File Index No. DT -28-99 a request to consider approval of Tentative Tract Map No. 16019, a subdivision of approximately 11 acres of land into 52 single family residential parcels, and an Environmental Determination; and WHEREAS, the Planning Commission recommended denial of File Index No. DZ -09-99 and denied File Index No. DT -28-99; and WHEREAS, the applicant made a timely appeal of the Planning Commission's decisions concerning the Zone Change and Tentative Tract Map No. 16019 ("Appealed Decisions"); and WHEREAS, on September 7, 1999, the City Council of the City of Colton conducted a duly noticed public hearing on File Index No. DZ -09-99 and File Index No. DT -28-99 at which time all persons wishing to testify in connection with the Appealed Decisions where heard and the Appealed Decisions were fully studied; and WHEREAS, all other legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE I CITY OF COLTON: SECTION 1.
