R-81-99 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON, UPHOLDING THE PLANNING <br />COMMISSION'S RECOMMENDATION TO DENY FILE <br />INDEX NO. DZ -09-99 (ZONE CHANGE FROM R-1 TO R- <br />1/PC) AND THE PLANNING COMMISSION'S DECISION <br />TO DENY FILE INDEX NO. DT -28-99 (TENTATIVE <br />TRACT MAP NO. 16019) <br />WHEREAS, the Planning Commission of the City of Colton did hold a Public <br />Hearing on July 27, 1999 for File Index No. DZ -09-99, a request to consider a change <br />of zone from R-1 (Single Family Residential) to R-1/PC (Single Family Residential <br />Planned Community), and File Index No. DT -28-99 a request to consider approval of <br />Tentative Tract Map No. 16019, a subdivision of approximately 11 acres of land into <br />52 single family residential parcels, and an Environmental Determination; and <br />WHEREAS, the Planning Commission recommended denial of File Index No. <br />DZ -09-99 and denied File Index No. DT -28-99; and <br />WHEREAS, the applicant made a timely appeal of the Planning Commission's <br />decisions concerning the Zone Change and Tentative Tract Map No. 16019 <br />("Appealed Decisions"); and <br />WHEREAS, on September 7, 1999, the City Council of the City of Colton <br />conducted a duly noticed public hearing on File Index No. DZ -09-99 and File Index No. <br />DT -28-99 at which time all persons wishing to testify in connection with the Appealed <br />Decisions where heard and the Appealed Decisions were fully studied; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />I CITY OF COLTON: <br />SECTION 1. Based on the entire record before the City Council, all written and <br />oral evidence presented to the City Council, the Agenda Report and the findings set <br />
