District Agreement No. 8-1099 <br />and location, advertising, award, contract administration, resident engineer, <br />independent assurance and specialty testing and such other construction engineering as <br />may be required for satisfactory completion of PROJECT and bear STATE's share of <br />the actual expense thereof. Estimates of such costs are shown on Exhibit A, attached <br />and made a part of this Agreement. <br />(2) To construct PROJECT by contract in accordance with plans and specifications of <br />STATE. <br />(3) To pay an amount equal to 75 % of the actual signal, lighting and roadwork related <br />construction cost, estimated to be $135,000 as indicated on Exhibit "A". In no event <br />shall STATE's total oblicration for construction costs under this Agreement, excluding <br />0 W <br />costs referred to in Section III, Article (9), exceed the amount of $155,250, provided <br />that STATE may, at its sole discretion, in writing, authorize a greater amount. <br />(4) To pay an amount equal to 75% of the actual signal, lighting and roadwork preliminary <br />L - <br />engineering costs, estimated to be $27,000 as indicated on Exhibit "A". <br />(5) To pay an amount equal to 75 % of the actual signal, lighting and roadwork <br />construction engineering cost, estimated to be $27,000 as indicated on Exhibit "A". <br />(6) Upon completion of PROJECT and all work incidental thereto, to furnish CITY with a <br />detailed statement of the portion of construction costs to be bome by CITY, including <br />resolution of any construction related claims which have been allowed to the <br />construction contractor. STATE thereafter shall refund to CITY promptly after <br />completion of STATE's audit, any amount of CITY's deposit required in Section II, <br />Article (1) remaining after actual costs to be borne by CITY have been deducted, or to <br />bill CITY for any additional amount required to complete CITY's financial obligations <br />pursuant to this Agreement. <br />(7) To maintain the entire traffic control signal and safety lighting as installed and pay an <br />amount equal to 100% of the total maintenance costs. <br />(8) To operate the traffic control signal as installed and pay 100% of the operation cost. <br />(9) To furnish the traffic signal control equipment for PROJECT. This equipment shall <br />consist of signal controller unit and signal control cabinet. The estimated cost of this <br />STATE -furnished equipment is $7,000, and shall be deducted from STATE's share of <br />the PROJECT costs. <br />01 <br />
