CITY OF COLTON
<br />AGREEMENT
<br />THIS AGREEMENT, made and entered into this 24t� day of July, 2000, which is the date tha ' t the
<br />Contractor properly delivered this Agreement and all other required documents to the City Clerk, in the
<br />County of San Bernardino, State of California, by and between the CITY OF COLTON, a municipal
<br />corporation (hereinafter "City") and, V.P.S. Enterprises (hereinafter "Contractor").
<br />WHEREAS, the City Council of the City of Colton at a meeting held on th e 6th day of June, 2000,
<br />authorize the City Manager and City Clerk to enter into this Agreement.
<br />NOW, THEREFORE, it is hereby agreed by and between the pates that:
<br />I . Performance of Work
<br />1.1 The Contractor shall furnish all of the labor, materials, tools, equipment, services and
<br />transportation necessary to perform all of the work described as follows:.
<br />Securing and Abating Public Nuisance Property.
<br />(hereinafter "Work,")
<br />1.2 The Contractor shall perform all of the work in strict accordance with the Contract documents.
<br />1.3 The Contractor shall be liable to the City for any damages arising from or as a result of, failure to
<br />fully comply with the Contract Documents. Contractor shall not be excused with respect to any
<br />failure to so comply by any act or omission of the City, its officers, employees or agents, unless
<br />such act or omission actually prevents the Contractor from fully complying with the requirements
<br />of the Contract Documents, , I
<br />1.4 Contractor shall,'at the Contractor's sole expense, obtain'all necessary permits and licenses for
<br />the work, including but not limited to, a valid City business license, and give all necessary notices
<br />and pay all fees and taxes required by law
<br />2. Schedul
<br />2.1 The Contractor shall commence the work'on an as needed basis within five (5) days after contract
<br />execution and the contractor has received the Notice to Proceed and a City of Colton Purchase
<br />Order, except as such time may be extended in writing by the City.
<br />3. Contract Price
<br />3.1 The C ' ity shall pay to the Contractor as full consideration for the faithful performance of the
<br />contract entered into by this Agreement, subject to any additions or deductions as provided in the
<br />Contract Documents, the maximum sum of $20,000 per year as needed. '
<br />4. Payment
<br />4.1 Upon receipt of an applicable invoice, the City will make payments to the Contractor in
<br />accordance with the Specifications.
<br />4.2 In the event there i's any claim specifically excluded by Contractor from the operation of any
<br />release, there shall be retained by City an amount not to exceed the amount of the disputed claim.
<br />5. Nondiscrimination in Employment
<br />5.1 Neither the Contractor, nor any subcontractor under the. Contractor, shall discriminate in the
<br />employment of persons upon the work because of the race, religion, creed, color, national origin,
<br />ancestry, physical handicap, medical condition, marital status, sex or age of such person, except
<br />as provided in Sections 12490 and 12491 of the Government Code. The Contractor shall have
<br />responsibility for compliance with this Section (Gov't. Code SS 12490, 12491).
