He <br />stated that he- would like additional information on other businesses that were <br />interested in locating into the vacant building. <br />Vice -Chairperson Oliva inquired about the easement rights. Mr. Soto stated that legal <br />documents regarding the easement rights have not been provided to Staff. Vice - <br />Chairperson Oliva stated that she understood the homeowners concerns. She stated <br />that she would like to see the Specific Plan for the area. She indicated that she <br />believes competition is good for businesses and does not understand why those <br />issues could not be worked out between the dealers. She stated that she would like <br />to see something else locate into the building. <br />Chairperson Vilches indicated that he also agrees with Commissioner Suchil. He <br />stated that they must look at what is best for the area and that he does not believe this <br />is the best thing for that location. <br />Commissioner Suchil stated that he does not want this to appear as a personal attack <br />on the business but that he does not feel this is the proper location for it. <br />Commissioner Suchil moved to deny File Index Number DC -69-99; seconded by <br />Commissioner Chavez, motion carried with Vice -Chairperson Oliva abstaining. <br />Mr. Soto informed the applicant of their appeal rights. <br />Commissioner Carter returned to the dais. <br />2. FILE INDEX NUMBER: DV -01-00 COBRA EQUIPMENT RENTALS <br />Mr. Soto read the staff report indicating that the request is for a Major Variance to <br />reduce the landscaping requirement of 25% of total lot area. He stated that on <br />January 18, 2000, the DRC considered the proposed project and that the Committee <br />recommends that the Commission approve the Major Variance with the Conditions of <br />Approval. He indicated that staff concurs with the recommendation by the DRC. Mr. <br />Soto stated that the proposed project is consistent with the intent and guidelines of <br />the General Plan; the proposed project will be consistent with the Zoning Ordinance if <br />it is granted a Conditional Use Permit and complies with the Conditions of Approval; <br />special circumstances relating to the size of the property and approved land use <br />warrant a Major Variance; and that the proposed project is compatible with the <br />surrounding uses and is exempt under C.E.Q.A. <br />Commissioner Prieto expressed concern about the request for reduced landscaping <br />and stated that he does not understand how the applicant is being deprived enough to <br />warrant a Major Variance. Mr. Soto explained the layout of the property and <br />surrounding properties. Commissioner Prieto questioned what would be at the rear of <br />the property. <br />
