City of Colton Agenda Report Council Meeting of March 21, 2000 Page 2 The agreement shall be effective from February 15, 2000 through approximately May 31, 2000 with regards to the District using the pool. With regards to the District providing offsets for up to 50% of the heating costs for the pool, the agreement will be effective through December 31, 2000 (as stated above). District shall maintain liability insurance with the City named as additionally insured prior to the commencement of activities. The agreement may be extended by mutual consent of both parties. Non -substantive changes to this agreement may be made by mutual consent of the City Manager and the District Superintendent with the consent of legal counsel for the City and the District. ALTERNATIVES: The City council has the option not to approve the Joint Use Agreement. ENVIRONMENTAL IMPACT None FISCAL IMPACT: The estimated cost to heat the pool from February 15, 2000 to May 31, 2000, is approximately $3,000. The District will pay up to fifty percent (50%) of the heating costs of the pool by providing offsets as explained above. Estimated General Fund impact of this agreement not including the aforementioned offsetting costs is $3,000. Funding will be made available from Account #100-6200-6203-2320 Aquatic Facility Utilities Expense. ryl J.
