JOINT USE AGREEMENT FOR FACILITY USE <br />Between the City of Colton and The Colton Joint Unified School District <br />This Agreement entered into on the 21st day of March 2000 by the City of Colton and the Colton Joint <br />Unified School District, hereafter referred to as "City" and "District." <br />WHEREAS, the Education Code of the State of California authorizes and empowers public school districts <br />and municipalities to cooperate with each other for the purposes of providing meaningful leisure and <br />educational opportunities, and toward that end enter into agreements with each other for the purpose of <br />organizing, promoting and conducting such programs of community recreation and education objectives for <br />children and adult citizens of the State, and, <br />WHEREAS, in order to minimize the duplication in the provision of these services, and to maximize the <br />potential for quality programs, both agencies are committed to cooperation with one another whenever <br />feasible; and, <br />WHEREAS, the City is the owner of a municipal pool facility at the Colton Community Center, located at <br />670 Colton Avenue, Colton, California; and, <br />WHEREAS, the District wishes to utilize the City swimming pool facility from February 15, 2000 to on or <br />about May 31, 2000. <br />NOW, THEREFORE, the parties agree as follows: <br />I. TERM: <br />The term of this Agreement shall be for a period of four months, commencing February 15, 2000, and <br />ending on or about May 31, 2000. Time of daily usage shall be from 2:30 to 5:00 p.m. <br />IEL CONSIDERATION: <br />A. During the term of this Agreement, the City of Colton shall make the pool and all accompanying <br />facilities available for use by the District from February 15, 2000, to on or about May 31, 2000. <br />Daily usage times shall be from 2:30 to 5:00 p.m. <br />B. The District agrees to pay the City up to 50% of the heating costs of the pool facility accumulated <br />during the time of usage by the District. Payment as compensation for such costs shall be in the <br />form of the District offsetting such costs against the costs of services normally provided by the <br />District to the City. For the purpose of offsetting up to 50% of the costs of heating the pool the <br />term of this agreement will expire on December 31, 2000. <br />C. The City and/or the District will provide an accounting of the costs and the offsets associated with <br />this agreement twice, once prior to July 31, 2000 (for costs/offsets through May 31, 2000) and <br />once prior to February 28, 2001 (for costs/offsets through December 31, 2000). <br />D. By mutual consent of both parties, this Agreement may be extended to include additional water <br />sport programs. <br />
