JOINT USE AGREEMENT FOR FACILITY USE Between the City of Colton and The Colton Joint Unified School District This Agreement entered into on the 21st day of March 2000 by the City of Colton and the Colton Joint Unified School District, hereafter referred to as "City" and "District." WHEREAS, the Education Code of the State of California authorizes and empowers public school districts and municipalities to cooperate with each other for the purposes of providing meaningful leisure and educational opportunities, and toward that end enter into agreements with each other for the purpose of organizing, promoting and conducting such programs of community recreation and education objectives for children and adult citizens of the State, and, WHEREAS, in order to minimize the duplication in the provision of these services, and to maximize the potential for quality programs, both agencies are committed to cooperation with one another whenever feasible; and, WHEREAS, the City is the owner of a municipal pool facility at the Colton Community Center, located at 670 Colton Avenue, Colton, California; and, WHEREAS, the District wishes to utilize the City swimming pool facility from February 15, 2000 to on or about May 31, 2000. NOW, THEREFORE, the parties agree as follows: I. TERM: The term of this Agreement shall be for a period of four months, commencing February 15, 2000, and ending on or about May 31, 2000. Time of daily usage shall be from 2:30 to 5:00 p.m. IEL CONSIDERATION: A. During the term of this Agreement, the City of Colton shall make the pool and all accompanying facilities available for use by the District from February 15, 2000, to on or about May 31, 2000. Daily usage times shall be from 2:30 to 5:00 p.m. B. The District agrees to pay the City up to 50% of the heating costs of the pool facility accumulated during the time of usage by the District. Payment as compensation for such costs shall be in the form of the District offsetting such costs against the costs of services normally provided by the District to the City. For the purpose of offsetting up to 50% of the costs of heating the pool the term of this agreement will expire on December 31, 2000. C. The City and/or the District will provide an accounting of the costs and the offsets associated with this agreement twice, once prior to July 31, 2000 (for costs/offsets through May 31, 2000) and once prior to February 28, 2001 (for costs/offsets through December 31, 2000). D. By mutual consent of both parties, this Agreement may be extended to include additional water sport programs.
