As a result of <br />these changes the new established park fee will be $936 per unit for single-family <br />residential projects, and $831 per unit for multi -family residential projects. <br />DISCUSSION/ANALYSIS: <br />On September 14, and October 26, 1999, the Study was presented to the City Council <br />in workshop format. At that time the need to amend Ordinance No. 0-03-95, and the <br />existing Quimby Act Ordinance (Ordinance No. 0-10-88) at a time subsequent to the <br />approval of a new development fee ordinance was presented. Furthermore, on March <br />7, 2000, a public hearing was held recommending the findings noted in the Study, and <br />approving and adopting a new development fee ordinance, Ordinance No. 0-02-00. As <br />part and parcel of that report, staff explained that it would be coming back before the <br />City Council to amend Ordinance No. 0-03-95, and the existing Quimby Act Ordinance <br />to extend it to include single family permits, residential subdivisions containing four or <br />fewer lots, and apartment complexes. Additionally, it would request that the existing <br />Quimby Act Ordinance be amended to provide for fees to offset improvement costs as <br />well as land acquisition or dedication costs. <br />ENVIRONMENTAL IMPACT: <br />None <br />FISCAL IMPACT: <br />We anticipate that revenues will increase as a result of this action, as park fees will be <br />assessed on specific project types that are presently exempted from our existing <br />Quimby Ordinance from paying the park fees established that Ordinance. Rather, these <br />projects currently pay a lower fee under Ordinance No. 0-03-95. Specifically, the <br />project types currently exempted from park fees are single-family permit projects, <br />residential subdivisions containing four or fewer lots, and apartment complexes. <br />Additionally the park fee formula was modified (by Ordinance No. 0-02-00) to include <br />cost recovery for a portion of park improvements and not just land acquisition costs or <br />land dedication costs. <br />RECOMMENDATION: <br />Staff recommends the following amendment to Ordinance No. 0-03-95: <br />Amend Section 3.32.030 to specifically exempt single-family residential permit projects, <br />and residential subdivisions containing less than four parcels and apartment complexes <br />from the "construction tax." <br />Staff recommends the following amendments to Ordinance No. 0-10-88: <br />Amend Section 16.58.010 C. regarding Park and Recreation Dedication and Fee <br />Exemptions. Delete the first paragraph of this section exempting subdivisions <br />containing less than five parcels, parcels not used for residential purposes, etc. The <br />second paragraph of this section remains intact. <br />
