Item #3 <br />ORDINANCE NO. 414 1 <br />1 <br />2 AN ORDINANCE OF THE OF THE CITY COUNCIL OF THE <br />3 CITY OF COLTON AMENDING SECTION 18.12.090 OF THE <br />4 COLTON MUNICIPAL CODE RELATING TO MAXIMUM <br />BUILDING COVERAGE IN THE R-1 (SINGLE FAMILY <br />5 RESIDENTIAL) ZONE: FILE INDEX NO. DT -44-01. <br />6 <br />7 <br />WHEREAS, the City Council of the City of Colton (the "City Council") held a duly <br />8 noticed public hearing on August 21, 2001, after giving published notice, of an amendment to Section <br />9 18.12.090 of the Colton Municipal Code relating to maximum building coverage in the R-1 (Single <br />Family Residential) zone (the "Zone Text Amendment"); and <br />10 <br />11 WHEREAS, on July 24, 2001, the Planning Commission of the City of Colton <br />12 <br />("Planning Commission") also conducted a duly noticed public hearing on the Zone Text Amendment <br />at which time all persons wishing to testify in connection with the Zone Text Amendment were heard <br />13 and the Zone Test Amendment was comprehensively reviewed and recommended for approval; and <br />14 WHEREAS, the City Council has determined that the Zone Text Amendment is <br />15 consistent with the City of Colton General Plan as indicated below; and <br />16 <br />WHEREAS, the City Council has determined that the proposed Zone Text <br />17 Amendment is in the best interests of the City, promotes the public health, safety and welfare of the <br />18 community and would be in the public interest to approve the Zone Text Amendment; <br />19 WHEREAS, the Application was reviewed, studied, and found exempt from the <br />20 California Environmental Quality Act ("CEQA') as more fully described below; and <br />21 WHEREAS, all other legal prerequisites to the adoption of this Ordinance have <br />22 occurred. <br />23 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />24 CITY OF COLTON: <br />25 SECTION 1. Section 18.12.090 of the Colton Municipal Code is hereby amended <br />26 to read as follows: <br />27 "The maximum lot coverage of all buildings on R-1 Single Family Residential zoned <br />28 lots shall not exceed forty percent (40%) of the total lot area, combined total square footage of main <br />structure and accessory structures. The square footage is calculated on the footprint of the first floor <br />
