CLAIM SERVICE AGREEMENT SAN\r^ t <br />This Agreement is between Carl Warren and Company; hereafter referred <br />to as "Service Company" with its principal office at 750 The City Drive South, <br />Suite 400, Orange, CA 92868. The Branch Office of the City of Colton Third <br />Party Claims Administration Service is located at 268 W. Hospitality Lane, Suite <br />206, at San Bernardino, CA 92412. The City of Colton, hereafter, collectively will <br />be referred to as the "Client." <br />WHEREAS, the Service Company operates a business that provides <br />claims administration services; and <br />WHEREAS, the Client has requested that the Service Company perform <br />certain services on behalf with respect to liability claims on the terms set forth <br />below, <br />NOW THEREFORE, in consideration of the foregoing mutual promises <br />the parties hereby agree: <br />ARTICLE I <br />Term Of Agreement: <br />This Agreement shall be effective for a period of three years commencing <br />October 1,2001, and ending September 30, 2002, and shall remain in force and <br />effect until amended or canceled as provided in the cancellation clause. <br />ARTICLE II <br />Service Company Agrees To: <br />A. Upon receipt of any claim, make immediate contact with the City to <br />discuss the allegations contained in the claim, the investigation needed, <br />and contact with the claimant. At this time a determination will be made as <br />to the method of contact with the claimant, either by phone or in person. If <br />personal contact is deemed necessary, a determination will be made as to <br />whether contact will be made by City staff or the Service Company. <br />B. Contact all claimants within 24 hours of receipt of the claim. All <br />unrepresented claimants will be provided a toll free number for contact <br />with the Service Company. <br />C. Work with the City to develop an emergency response plan for serious <br />incidents, including sewer back-ups. <br />D. Work with the City to establish guidelines for investigation to ensure <br />investigations are conducted timely. <br />
