1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />011 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />ORDINANCE NO. 0-05-02 <br />AN ORDINANCE OF THE CITY OF COLTON AMENDING SECTIONS <br />7.08.100 AND 7.08.150 OF THE COLTON MUNICIPAL CODE AND <br />ADDING CHAPTER 7.10 OF TITLE 7 OF THE COLTON MUNICIPAL <br />CODE REGARDING VICIOUS DOGS <br />WHEREAS, the City of Colton ("City") is authorized pursuant to Article 7, Section 11 <br />of the California Constitution to "make and enforce within its limits all local, police, sanitary, <br />and other ordinances and regulations not in conflict with general laws ", including the <br />regulation of animals; and <br />WHEREAS, the City is authorized pursuant to Food and Agriculture Code Sections <br />31621 and 31683 to adopt and administer an administrative procedure for the regulation <br />and prohibition of potentially dangerous and vicious dogs; and <br />WHEREAS, the City is further authorized by Government Code Section 36901 to <br />impose fines, penalties, and forfeitures for violations of the City's ordinances; and <br />WHEREAS, the City Council of the City of Colton hereby finds and declares all of <br />the following: <br />(a) Potentially dangerous and vicious dogs have become a serious and <br />widespread threat to the safety and welfare of citizens of this City. In recent years, they <br />have assaulted without provocation and seriously injured numerous individuals, particularly <br />children, and have killed numerous dogs. Many of these attacks have occurred in public <br />places. <br />(b) The number and severity of these attacks are attributable to the failure of <br />11 owners and keepers of dogs to register, confine, and properly control vicious and <br />11 potentially dangerous dogs. <br />(c) The necessity for the regulation and control of vicious and potentially <br />II dangerous dogs is a serious problem, requiring swift reaction by the City, and existing laws <br />II are inadequate to deal with the threat to public health and safety posed by vicious and <br />28 11 potentially dangerous dogs. <br />RVPUBUSB\629353 <br />-1- <br />
