Inc <br />AND <br />THE CITY OF COLTON <br />As Approved by Colton City Council on December 3, 2002 <br />Upon execution of this Electric Service Agreement ("Agreement") between the City of Colton ("City") and Jon -Lin, <br />Inc. ("Jon -Lin") the parties agree, covet, and proclaim: <br />WHEREAS, Jon -Lin is an electric customer of the City and has established electric service in accordance with the <br />City's adopted rules and regulations as established in the Customer Service Policy; and, <br />WHEREAS, City is a municipal corporation located in the County of San Bernardino and organized under the <br />general laws of the State of California; and, <br />WHEREAS, City owns and operates a municipal electric utility providing the electric needs for residential, <br />commercial, and industrial customers located within the City limits, and, <br />WHEREAS, City has created a rate schedule, Rate Schedule CS, which allows customers with peak demands in <br />excess of 150 kiloWatts to negotiate electric rates reflective of their particular electric service requirements; and, <br />WHEREAS, Jon -Lin qualifies for the negotiated rate and has requested such in writing to the City; and, <br />WHEREAS, City and Jon -Lin agree that it is in the best interest for the parties to execute this Agreement. <br />NOW THEREFORE, Jon -Lin and City agree to the following terms and conditions: <br />1. TERM <br />A. The term of this rate shall be for a period of sixty (60) months from the effective date of May 15, 2002. <br />The negotiated rate shall be applied during the first available full billing period (month) following the <br />effective date and shall not be effective for more than eleven (59) successive billing periods. No pro- <br />ration of any billing period subsequent to the execution of this agreement shall be allowed. <br />2. RATE <br />A. The City will render the monthly bill to Jon -Lin based upon monthly metered data for the facility at 1620 N. <br />"8th" Street at a rate of $0.0989 (9.89 cents) per kiloWatt hour. This rate will be an all exclusive rate for <br />demand, energy, and customer charges, including those included in the Power Cost Adjustment. The rate <br />will not include any taxes applicable to the provision of electric service in the City. This would include <br />State Energy Taxes, Utility Users Taxes, or others imposed by the City or other Governmental agencies. <br />3. SERVICES TO BE RENDERED <br />A. The City will provide electric service to Jon -Lin in a manner of quality and reliability consistent with that <br />provided to other customers served within the City in accordance with all applicable provisions as <br />established by the City Customer Service Policy. <br />B. This rate will be limited to a maximum coincidental metered demand of two (2) megaWatts, and a <br />minimum coincidental metered demand of 1,200 kiloWatts. In the event that the coincidental metered <br />demand falls outside of these stated limits, the Jon -Lin electric bill for that month of service will be <br />rendered on the then -applicable Time of Use Rate. <br />4. PAYMENT AND INQUIRIES <br />A. The Jon -Lin account will be billed monthly by City and payment will be made in accordance with the City's <br />adopted Rules and Regulations for electric service. Any inquiries regarding the bill shall be made to the <br />City of Cotton, Utility Department, Customer Service. <br />B. Any questions regarding the physical service connection, power quality, or problems with the delivery of <br />power shall be made to the City of Colton, Public Utility Department, Electric Utility. <br />
