Report to City Council and Redevelopment Agency Board regarding Letter to Board of Supervisors for La <br />Cadena Corridor Project Area <br />December 17, 2002 <br />Page 2 of 3 <br />Community Redevelopment Law authorizes sister jurisdictions to cooperate in the <br />redevelopment of territory of one jurisdiction (in this case the unincorporated county island <br />area marked on the vicinity map) by delegating redevelopment powers with respect to such <br />areas to a neighboring community (in this case, the City of Colton and the Redevelopment <br />Agency for the City of Colton). This can be accomplished by either a joint exercise of powers <br />arrangement (Health and Safety Code section 33210), or it can be accomplished by one <br />jurisdiction approving an ordinance, which authorizes another jurisdiction to undertake a <br />redevelopment project affecting its territory (Health and Safety Code Section 33213). <br />It appears that an efficient means of coordinating the commencement of the redevelopment of <br />the unincorporated county area and ensuring the integration of such efforts with the <br />redevelopment program for the larger project area can be achieved if the County of San <br />Bernardino Board of Supervisors adopts an ordinance, pursuant to Health and Safety Code <br />Section 33213, which authorizes the City of Colton and the Redevelopment Agency for the <br />City of Colton to undertake the redevelopment of the county unincorporated area before the <br />annexation process is complete. In such fashion the City and the Agency would be authorized <br />by San Bernardino County to undertake the redevelopment of the county area in all respects <br />as if this area were already inside the territorial boundaries of the City. In essence, under such <br />a procedure the City and the Agency would be responsible for conducting all of the <br />proceedings for the formation of a redevelopment project area that includes the county <br />unincorporated area. Upon the completion of the process, the Agency would receive tax <br />increment revenues from the county area (before the annexation process is completed) and the <br />Agency would be responsible for undertaking specific redevelopment activities affecting the <br />county area. When the annexation proceedings are completed, this area will already be <br />included in a redevelopment project area administered by Colton, and an amendment to the <br />redevelopment plan could thereby be avoided. <br />Accordingly, it is requested that the City Council authorize and direct staff to transmit a letter <br />to the Board of Supervisors requesting that it consider the adoption of an ordinance <br />authorizing the City and the Agency to undertake the formation and administration of a <br />redevelopment project area, which includes the county unincorporated area. If the Board of <br />Supervisors is receptive to the proposal, then Agency staff will prepare a draft county <br />ordinance in consultation with City and County staff, which delegates community <br />redevelopment powers to Colton with respect to the county unincorporated area pursuant to <br />Health and Safety Code Section 33213. The final form of such an ordinance will be presented <br />to the City Council for its concurrence before it is acted upon by the County Board of <br />Supervisors. <br />In the meantime, as the County considers such a request, it is also proposed that the City's <br />Planning Commission consider the selection of proposed project area boundaries under two <br />scenarios: (1) include the unincorporated county area under the assumption that the County <br />will accept the proposal of Colton regarding redevelopment powers on this area, and (2) <br />exclude the unincorporated county area from the proposed redevelopment project area.
