All of SCPPA's wsts to the extent not paid from the proceeds of Bonds, notes or other evidence of indebtedness issued in anticipation of Bonds, resulting from the ownership, operation and maintenance of and renewals and replacemenu to the Project. SCPPA shall apply, as a credit against Total Monthly Power Cosu, all receipts, revenues and other moneys received by SCPPA from surplus equipment, materials, supplies or Energy sold prior to the Date of Fnm Operation for the benefit of SCPPA. Total Monthly Power Costs shall consist of (i) an operating cost component (described in Section 4.7.1), (ii) a fuel cost component (described in Section 4.72), (iii) a Project A Indenhue cost component (described in Section 4.73), (iv) a Project B Indenture cost component (described in Section 4.7.4) and (v) a Project C Indenture cost component (described in Section 4.7.5), and shall include, but not be lunited to, the items of cost and expense referred to in this Section 4.7 tha[ aze accrued or paid by SCPPA dwing each Month of each Power Supply Year. In the event any Power Supply Yeaz shall consist oF fewer than twelve Months, the fraction set forth in [he following Sections 4.7. ], 4.7.3.3, 4.7.43 and 4.7.5.3 shall be adjusted accordingly and, in the event of any revision of the Annual Budget after the commencement of any Power Supply Yeaz, the amount determined pursuant ro said Sections shall be appropriately adjusted so that any increase or decrease in the portion of the Annual Budget applicable to said Sections shall be evenly apportioned over the remaining Months of such Power Supply Yeaz. 4.7.1 The operating cost component of the Total Monthly Power Costs shall consist of: one-twelfth of the cosu of producing and delivering Capacity and Energy during such Power Supply Yeaz, including, but not limited to (i) ordinary operation and maintenance costs, administrative and general costs, cosu relating to litigation (including attorneys' fees and disbursements and other amounu paid as a result of such litigation), insurance costs (including amounts to fund any self-inswance program), overhead costs, taxes required to be paid by SCPPA with respect to the Project, and any other costs payable by SCPPA in connection with the output of the Project; provided, however, such costs shall not include any damages or costs, including legal costs, relating to Willfu] Actions of the Operating Agent, and (ii) all costs related to the conducting of the business of SCPPA with respect to the Project, including the applicable portion of salazies, fees for legal, engineering, financial and other services and all other expenses properly related to the conduct of such affairs 45049822.18 (PSA Project A)
