package, TDA will perform additional analyses based on mutual agreement on the scope ofwork and a modified fee. The end product of this effort will be a final decision-making package available for adoption by the City. Up to thirty-five copies of the final package will be provided to the City. TDA will assist with the distribution of these documents. These responses to comments will be prepazed as a combined document be for distribution. The fee for this task will be $3,500, including printing and mailing costs. These latter expenses will be invoiced at actual cost to the City and the estimate is $1,000. Task 5: Following a decision to approve the proposed project, TDA will provide and file a Notice of Determination (NOD) for the City if the project is approved. NODs will be filed with the San Bernardino Counry Clerk of the Board and the State Clearinghouse. The fee for this task is $500. The fee does not include the NOD filing fee with the County which will be $1,285. Task 6: TDA will attend up to two public meetings/heazings (8 hours, if required) for a fee not to exceed $1,000. Additional meetings/hearings can be negotiated with an hourly billing rate of $125 per hour. All meetings with Staff and applicant are included in the previous task cost estimates. Total estimated fee for implementing the above scope of work, without any of the extra costs is: $36,150. This is a not to exceed fee and actual costs will be invoiced for those tasks identified above, but will not exceed this fee estimate, unless additional tasks aze authorized to TDA. Schedule TDA proposes the following schedule: a. Assuming the data are available, day I S following authorization TDA will complete a draft project description for review. b. Immediately upon authotization, the technical studies will be initiated. By day 45 (assuming all technical studies aze available), TDA proposes to have the internal review copy of the IS completed for review. This part ofthe schedule is dependent upon availability of the biology data from the City c. Assuming that the City completes review of the Initial Study in two weeks, TDA will complete and print the proposed Negative Declaration by day 75. d. Following the mandatory 30-day public review period (about day 110), TDA anticipates completing the final decision-making package within IS days. This document will be submitted to the City for review. e. Assuming that the City completes review of the final decision-making package in one week, the final package can be disuibuted by about day 130. The public heazing can be completed 4
