El <br />3) MODIFICATION OF SERVICES — No portion of the services or responsibilities of either <br />party described in this Agreement may be eliminated, reduced, or appreciably changed <br />without the mutual written consent of both parties. <br />4) COMPENSATION — DISTRICT agrees to reimburse POLICE an amount not to exceed fifty - <br />thousand dollars ($50,000.00) per fiscal year, paid annually on July 1 of the following year, <br />to cover the costs of POLICE employing a COMMUNITY SERVICE OFFICER to assume <br />the OFFICER'S other duties related to his employment with POLICE. All overtime incurred <br />by the School Resource Officer will be paid by the POLICE. <br />5) VACATION AND HOLIDAY TIME <br />a) OFFICER'S vacation shall not conflict with the schedule of duties and services mutually <br />developed by DISTRICT and POLICE. <br />b) Because DISTRICT and POLICE holidays may not correspond, holiday time will be <br />taken by OFFICERS in accordance with DISTRICT holidays during the contract period. <br />Any excess days shall be taken with reasonable notice of DISTRICT, but shall not <br />conflict with the schedule of duties and services mutually developed by DISTRICT and <br />POLICE. <br />6) ADMINISTRATION AND SUPERVISION <br />a) The chief of POLICE (or designee) shall administer this Agreement and supervise <br />OFFICER on behalf o the CITY. The Superintendent of DISTRICT (or designee) shall <br />administrator this Agreement on behalf of the DISTRICT. <br />b) Selection of OFFICERS shall be by mutual agreement and evaluation of services shall <br />be done annually by POLICE with DISTRICT input into OFFICER evaluation. <br />c) POLICE shall ensure OFFICER has been fingerprinted and had a background check <br />performed in accordance with the requirements of Education Code section 45125.1. <br />POLICE shall maintain records in their files in accordance with their procedures with <br />copies of OFFICER"S fingerprints and background check report, prior to the OFFICER <br />being assigned to Colton High School. <br />d) All complaints filed against OFFICER by the DISTRICT, a student, a parent, a District <br />employee, or a member of the community, shall be forwarded to POLICE. Police shall <br />investigate the complaint and determine the appropriate action to be taken. DISTRICT <br />shall be permitted to provide input into the investigation. DISTRICT may request <br />removal of OFFICER with cause. <br />7. CITY EMPLOYEE — OFFICERS shall remain employees of POLICE on special <br />assignment to DISTRICT for the purpose set forth in this Agreement, and sall not be <br />considered agents, employees, or officers of DISTRICT. <br />8. TERMINATION — either party may terminate this Agreement at any time by giving written <br />notice to the other party of such termination and specifying the effective date thereof, at <br />Page 2 of 7 <br />
