R-37-02 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON SETTING FEES PERTAINING TO THE <br />APPREHENSION OF ANIMALS WITHIN THE CITY <br />WHEREAS, the City Council of the City of Colton is empowered to impc <br />reasonable fees, charges and rates for municipal services, pursuant to Article A, Section 7 <br />the California Constitution; and <br />WHEREAS, it is the intention of the City Council that the fees herein shall cover <br />but not exceed, the estimated reasonable cost of providing the service for which the fee is <br />charged; and <br />WHEREAS, based upon the evidence provided, the City Council he <br />determines that the fees established herein reasonably cover, but do not exceed, <br />reasonable cost of providing the service for which the fee is charged. <br />BE IT NOW THEREFORE RESOLVED AS FOLLOWS: <br />SECTION 1. Fees. The following fees and charges are hereby established <br />recover the City's cost of providing municipal services to the public as follows: <br />Animal Apprehension Fee <br />A. Apprehension fee for animals picked up by the Animal Control Officer <br />(Colton Mun. Code § 7.08.080): <br />$30 per hour, billed in quarter hour increments ($7.50 for each quarter <br />hour). <br />SECTION 2. Charges and Fees to cover actual costs. In the event that the <br />incurs additional costs related to apprehending an animal within the City by the Animal <br />Officer or other Public Safety personnel, the City may charge the owner of said <br />additional charges and fees equal to the amount of actual costs incurred by the City. <br />actual costs may include, but not be limited to, animal shelter fees, animal hospital <br />
