Appeal by East Valley Land Company <br />City Council Meeting of May 7, 2002 <br />Page 2 <br />side and adjacent to the Interstate 215 Freeway. The project site is located in the Cooley Ranch Planned <br />Community and is surrounded by Cooley Drive and the Interstate 10 and 215 Interchange on the north, the Reche <br />Canyon Flood Control Channel on the south, the Interstate 215 on the east, and vacant property and the Ashley <br />Furniture manufacturing facility on the west. <br />After receiving public testimony, the Planning Commission determined that the proposed billboards would create a <br />significantly negative impact on the existing environment, are inconsistent with the intent and guidelines of the <br />General Plan, do not warrant a Major Variance and they believed would have an undesirable impact to the area. <br />Therefore, the Planning Commission denied the applicant's request for a Major Variance and Conditional Use <br />Permit to allow the construction of one (1) electronic message board and five (5) outdoor advertising signs <br />(billboards). <br />ALTERNATIVES: <br />Deny the appeal by the applicant, which would uphold the Planning Commission's denial of File Index Number <br />DCV -98-01 or grant the applicant's appeal, which would overturn the Planning Commission's denial of File Index <br />Number DCV -98-01 allowing the construction of one (1) electronic message board and five (5) outdoor advertising <br />signs (billboards). <br />FISCAL IMPACT: <br />It is unknown at this time what the financial impact will be to the City. <br />ENVIRONMENTAL IMPACT: <br />Staff determined that the proposed project would have a significant impact on the environment. Staff recommends <br />that, should the City Council overturn the Planning Commission's denial, an Environmental Impact Report be <br />prepared for this project. <br />RECOMMENDATION: <br />Staff recommends that the City Council accept public testimony on the proposed project, and adopt the attached <br />Resolution upholding the Planning Commission's decision to deny a Major Variance and Conditional Use Permit <br />to allow the construction of one (1) electronic message board and five (5) outdoor advertising signs (billboards). <br />Should the Council choose to overturn the Planning Commission's denial, staff recommends that Council direct <br />staff to prepare appropriate environmental documents and conditions of approval and return to Council once these <br />have been completed. <br />Attachments: Planning Commission Minutes of February 26, 2002 <br />Copy of Appeals filed by East Valley Land Company <br />Planning Commission Staff Report <br />Resolution <br />REVIEW TEAM ONLY <br />City Attorney; Finance Director: <br />City Manager: c OTHER: <br />
