Item #2 CITY OF COLTON AGENDA REPORT FOR COUNCIL MEETING OF May 21, 2002 TO: Honorable Mayor and City Council FROM: City Attorney SUBJECT: 2081 Placentia Lane (3779 W. Placentia Lane) - Bobby W. Stark and Kathie L. Stark DATE: May 21, 2002 BACKGROUND: The City previously conducted administrative nuisance abatement proceedings with respect to conditions at the property located at 2081 Placentia Lane (3779 W. Placentia Lane) ("Property") and owned by Bobby W. Stark and Kathie L. Stark ("Owners"). The Owners were given notice of substandard maintenance and public nuisance conditions on the Property on three separate occasions in September and October 2001. In December 2001, a public hearing concerning the Property was held before the City's Code Enforcement Housing Appeals Board. The Board declared the Property a public nuisance and ordered the Owners to abate the Property. In January 2002, the Owners filed a timely appeal of the Board's decision. Since that time, the Owners and the City have engaged in settlement negotiations to resolve this matter, and the hearing on the appeal has been continued from time to time. DISCUSSION/ANALYSIS: The City Attorney's office has been working with representatives of the Owners to reach a mutually agreeable resolution, including preparing a settlement agreement between the Owners and the City. As of the date of preparation of this report, there are additional issues yet to be resolved between the Owners and the City. The City Attorney anticipates continuing to work through these issues up to the time of the City Council meeting scheduled for May 21, 2002. We are hopeful to be able to present a proposed settlement at that time. If not, an additional continuance of the hearing maybe required to either allow for more time to work out a settlement agreement or to allow City staff and the Owners to prepare for a hearing on the merits of the appeal.
