Item #2 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF May 21, 2002 <br />TO: Honorable Mayor and City Council <br />FROM: City Attorney <br />SUBJECT: 2081 Placentia Lane (3779 W. Placentia Lane) - Bobby W. Stark <br />and Kathie L. Stark <br />DATE: May 21, 2002 <br />BACKGROUND: <br />The City previously conducted administrative nuisance abatement proceedings with <br />respect to conditions at the property located at 2081 Placentia Lane (3779 W. Placentia <br />Lane) ("Property") and owned by Bobby W. Stark and Kathie L. Stark ("Owners"). The <br />Owners were given notice of substandard maintenance and public nuisance conditions on <br />the Property on three separate occasions in September and October 2001. In December <br />2001, a public hearing concerning the Property was held before the City's Code <br />Enforcement Housing Appeals Board. The Board declared the Property a public nuisance <br />and ordered the Owners to abate the Property. In January 2002, the Owners filed a timely <br />appeal of the Board's decision. Since that time, the Owners and the City have engaged in <br />settlement negotiations to resolve this matter, and the hearing on the appeal has been <br />continued from time to time. <br />DISCUSSION/ANALYSIS: <br />The City Attorney's office has been working with representatives of the Owners to reach a <br />mutually agreeable resolution, including preparing a settlement agreement between the <br />Owners and the City. As of the date of preparation of this report, there are additional <br />issues yet to be resolved between the Owners and the City. The City Attorney anticipates <br />continuing to work through these issues up to the time of the City Council meeting <br />scheduled for May 21, 2002. We are hopeful to be able to present a proposed settlement <br />at that time. If not, an additional continuance of the hearing maybe required to either allow <br />for more time to work out a settlement agreement or to allow City staff and the Owners to <br />prepare for a hearing on the merits of the appeal. <br />AVPM\NGS\632605 _1 <br />
