Fees. The contractor may charge a reasonable feeto the <br />users of its service, as established by the City Council pursuant to its agreement <br />with the contractor. At the City's sole option, the contractor shall also pay to the City <br />a fee established by the City Council pursuant to its agreement with the contractor. <br />Section 5. City Public Service Signs. No kiosk sign shall contain <br />more than seven (7) panels. Contractor shall place City public service panels on <br />any kiosk sign that contains five (5) or fewer panels at the time of the City's request. <br />City requests shall be made in writing and shall come only from the City Manager's <br />office. The Contractor shall be required to place up to two (2) City public service <br />panels per kiosk sign at no cost or expense to the City. All public service panels <br />shall meet the kiosk sign specifications attached hereto as Exhibit "B" and <br />incorporated herein by reference. <br />Section 6. Contractor Liabilities. Costs and Expenses. All liabilities, <br />costs and expenses arising out of the siting, installation, and construction of kiosk <br />signs and panels, as well as out of the administration of the provisions of this <br />Program, shall be borne by the contractor. The City shall have no obligation <br />whatsoever relating to or arising out of such liabilities, costs or expenses, except as <br />expressly provided for herein. <br />Section 7. Kiosk Sign and Panel Approval; Criteria. The installation <br />of each kiosk sign and the placement of each panel on each kiosk sign shall be <br />reviewed and approved by the Community Development Director without review by <br />the Planning Commission or the Design Review Committee. A proposal shall be <br />submitted by the contractor to the Community Development Director for each kiosk <br />sign and/or panel, which plan shall include the location of the proposed kiosk sign, <br />the name of each subdivision tract, apartment complex and/or recreational vehicle <br />dealer to be given a panel on the kiosk sign, and a statement that the kiosk signs <br />and panels shall comply with all requirements of this Resolution. The Community <br />Development Director shall approve a proposal which complies with the following: <br />(1) all kiosk signs shall be located only in those authorized locations indicated in <br />Exhibit "A" attached hereto; (2) all kiosk signs and panels shall be constructed and <br />painted in compliance with the kiosk sign specifications attached hereto as Exhibit <br />"B" and incorporated herein by reference; (3) any kiosk sign proposal on private <br />property shall be accompanied by the written consent of the landowner; (4) any <br />kiosk sign proposal on public property shall be accompanied with a City <br />Encroachment Permit application; and (5) kiosk signs shall not obstruct the view of <br />the traveling public, as determined in the City Engineer's sole and absolute <br />discretion. <br />Section 8. Kiosk Prohibitions. All kiosk signs and panels located <br />thereon shall comply with the following: (1) nothing other than a directional arrow <br />and the name of the subdivision tract, apartment complex or recreational vehicle <br />dealer shall appear on each panel; (2) any panel approved for a particular <br />subdivision tract, apartment complex or recreational vehicle dealer shall not be <br />changed to advertise another such entity without approval of the Community <br />Development Director pursuant to Section 7; (3) there shall be no additional tag <br />signs, streamers, devices, display boards or appurtenances added to the kiosk <br />RIVPUB/DRD/617732 <br />
