City Council Meeting — September 3, 2002 <br />Approval of a Professional Services Agreement <br />Page 2 of 2 <br />one from Michael Brandman Associates ($75,633) and one from The Keith Companies <br />($75,300). After staff reviews of both proposals and in consultation with the references listed by <br />the consultants, the firm of Michael Brandman Associates was found to best meet the needs of <br />the City. The applicant (Pacific Rail Industries) is required to pay for the Environmental Impact <br />Report and any subsequent environmental services in order to comply with CEQA. Thus <br />execution of this agreement is contingent upon the applicant entering into a reimbursement <br />agreement with the City. <br />ALTERNATIVES: <br />Reject staffs recommendation and direct staff to re -solicit request for proposals for professional <br />environmental services/CEQA processing for the proposed project. <br />FISCAL IMPACT: <br />None. The applicant (Pacific Rail Industries) will pay for all work required by the consultant for <br />the proposal, therefore, there is no cost to the City. <br />ENVIRONMENTAL IMPACT: <br />The action to hire a consultant is exempt under Section 15306 of the California Environmental <br />Quality Act (CEQA). <br />RECOMMENDATION: <br />Staff recommends that the City Council authorize the City Manager to enter and execute a <br />Professional Services Agreements with Michael Brandman Associates for Professional <br />Environmental Services/CEQA Processing for the Pacific Rail Industries Rail Dismantling and <br />Salvage Operations Facility, subject to the execution of a reimbursement agreement between the <br />applicant and the City. <br />Attachment: Michael Brandman Associates Professional Services Agreement Proposal <br />REVIEW TEAM ONLY <br />City Attorney: a-' Finance Director: <br />City Manager:"- <br />anager: ,(r - OTHER: <br />
