CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF April 1, 2003 <br />TO: Honorable Mayor and City Council <br />FROM: Ron Kenny, Director of Parks, Recreation & Family Services l <br />SUBJECT: Amendment to the Colton Municipal Code Regarding the Community <br />Facilities District Commission Powers and Duties <br />DATE: March 24, 2003 <br />BACKGROUND: <br />Item #2 <br />The City Council and staff have made community beautification a priority. Parks and public spaces are <br />being developed and maintained as areas of beauty. Much of this work is done through the City's two <br />Landscape Lighting and Maintenance Districts, LLMD #1 and LLMD #2. Each year the City Council must <br />review and approve each assessment district's Engineer's Report, which deals with the budget and <br />recommended assessments. Munifinancial, the City's assessment district consultant, develops this <br />information. <br />DISCUSSION/ANALYSIS: <br />In an effort to provide residents within the district areas additional due diligence, staff is recommending that <br />the City's Community Facilities District Commission be allowed to review each Engineer's Report and <br />provide the City Council with their recommendation. The recommendations would be provided to the <br />Council in May of each year for their review prior to it being placed on the Council agenda for approval in <br />June. <br />Currently, the CFD Commission does not have the authority within the Colton Municipal Code to provide a <br />review and recommendation of the City's assessment districts. Therefore, an amendment to the Municipal <br />Code, Section 2.43.050, Powers and Duties is required. A copy of the proposed resolution is attached. <br />FINANCIAL IMPACT: <br />None <br />RECOMMENDATION: <br />Staff recommends that City Council approve an amendment to the Colton Municipal Code increasing the <br />powers and duties of the Community Facilities District Commission to include assessment districts. <br />Attachment <br />REVIEW TEAM ONLY <br />City Attorney: Finance Director: <br />City Manager: OTHER: <br />
