CITY OF COLTON AGENDA REPORT FOR COUNCIL MEETING OF April 1, 2003 TO: Honorable Mayor and City Council FROM: Ron Kenny, Director of Parks, Recreation & Family Services l SUBJECT: Amendment to the Colton Municipal Code Regarding the Community Facilities District Commission Powers and Duties DATE: March 24, 2003 BACKGROUND: Item #2 The City Council and staff have made community beautification a priority. Parks and public spaces are being developed and maintained as areas of beauty. Much of this work is done through the City's two Landscape Lighting and Maintenance Districts, LLMD #1 and LLMD #2. Each year the City Council must review and approve each assessment district's Engineer's Report, which deals with the budget and recommended assessments. Munifinancial, the City's assessment district consultant, develops this information. DISCUSSION/ANALYSIS: In an effort to provide residents within the district areas additional due diligence, staff is recommending that the City's Community Facilities District Commission be allowed to review each Engineer's Report and provide the City Council with their recommendation. The recommendations would be provided to the Council in May of each year for their review prior to it being placed on the Council agenda for approval in June. Currently, the CFD Commission does not have the authority within the Colton Municipal Code to provide a review and recommendation of the City's assessment districts. Therefore, an amendment to the Municipal Code, Section 2.43.050, Powers and Duties is required. A copy of the proposed resolution is attached. FINANCIAL IMPACT: None RECOMMENDATION: Staff recommends that City Council approve an amendment to the Colton Municipal Code increasing the powers and duties of the Community Facilities District Commission to include assessment districts.
