Item #1 <br />CITY OF COLTON <br />AGENDA REPORT <br />FOR THE CITY COUNCIL MEETING OF APRIL 15, 2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS <br />FROM: AMER JAKHER, P.E., CITY ENGINEER � D <br />SUBJECT: FIRST READING OF ORDINANCE No. 0-03-0-- AMENDING <br />ORDINANCE No. 875, TO REFLECT MODIFICATIONS OF THE <br />INSURANCE REQUIREMENTS FOR CONSTRUCTION PERMITS <br />TO WORK WITHIN THE PUBLIC RIGHT-OF-WAY <br />DATE: APRIL 3, 2003 <br />BACKGROUND: <br />Ordinance No. 875, § 7 (part), (a), (b), 1955, an ordinance of the City of Colton regarding Streets <br />and Alleyways, refers to the type, form and amount of general liability policy to be submitted to the <br />City prior to the issuance of any permit for construction work within the public right-of-way. <br />Section 12.08.070, Part B of the City of Colton Municipal Code currently reads as follows: <br />`B. Public liability policy issued by a reliable insurance company approved by the city <br />with limits five thousand dollars/ten thousand dollars personal and one thousand <br />dollars property damage or equivalent cash, certified check or cashier's check in favor <br />of the city to cover such liability and to insure the city from any and all liability of every <br />nature whatsoever connected directly or indirectly with any such work " <br />ANALYSIS/DISCUS SION: <br />An increasing amount of work has been done on the City streets, alleyways, and within the public <br />right-of-way by various contractors, subcontractors, or private citizens/residents under the City's <br />current permit process. A portion of this work has resulted in claims of damage to person or <br />property. The requirements specified in the above -noted portion of Ordinance 875 are insufficient <br />to mitigate potential claims against the City, arising from improper/faulty work or traffic control <br />efforts during permitted construction. <br />Engineering has conducted inquiries as to the amount and type of liability insurance required by <br />surrounding cities in connection with permitted construction work within the public right-of-way. <br />Comparisons were also made regarding the requirements for the City of Colton Wide Load Permits, <br />which are based upon CalTrans requirements, and of the liability insurance requirements imposed <br />upon contractors for the City's Capital Improvement Program project contracts. <br />
