R-86-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON, ELECTING TO CEASE <br />TO BE SUBJECT TO THE PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT <br />ON BEHALF OF THE CITY CLERK AND CITY TREASURER UNIT <br />WHEREAS, Government Code Section 22853 provides that a contracting agency which <br />has elected to be subject to the Public Employees' Medical and Hospital Care Act (hereinafter "Act") <br />may cease to be so subject by proper application by the contracting agency; and <br />WHEREAS, the City of Colton (hereinafter "Contracting Agency") is a contracting agency <br />under the Act for participation by members of the City Clerk and City Treasurer Unit. <br />NOW, THEREFORE BE IT FURTHER RESOLVED by the Mayor and City Council of the <br />City of Colton as follows: <br />SECTION 1. That the City Clerk and City Treasurer Unit members of the Contracting Agency <br />elect, and the Contracting Agency does hereby elect, to cease to be subject to the provisions of the <br />Act. <br />SECTION 2. That coverage of the Act cease on December 31, 2003. <br />SECTION 3. That Title 2, Section 599.515 (e), of the California Administrative Code <br />prohibits the Contracting Agency from filing with the Board of Administration of the Public <br />Employees' Retirement System a new resolution electing to be subject to the Act within two - years <br />of termination date. (Presently, CalPERS has filed an emergency regulation with the Office of <br />Administrative Law amending section 599.515(e) to require contracting agencies to wait up to five - <br />years after termination before re-entering PEMHCA, at the Board's discretion. If the Office of <br />Administrative Law deems the requested change to be an emergency, it will be effective January 1, <br />2004.) <br />PASSED, APPROVED AND ADOPTED this 19th day of August, 2003. <br />ATTEST: <br />CAROLINA P.
