CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF AUGUST 5, 2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL I <br />FROM: Teresa S. Delgado, Human Resources Manager /O <br />Item #15 <br />SUBJECT: Approve the Findings of Fact and the Unit Modification for the <br />International Brotherhood of Electrical Workers (IBEW) Bargaining <br />Group <br />DATE: August 5, 2003 <br />BACKGROUND: <br />On November 27, 2002, the International Brotherhood of Electrical Workers (IBEW) Local 47 <br />submitted a Petition for Modification requesting that 33 employees in certain classifications of the <br />Water/Wastewater Department be included in the same bargaining unit as other employees <br />represented by IBEW. The San Bernardino Public Employees Association (SBPEA) currently <br />represents the group of employees seeking the unit modification. Per the Employer -Employee <br />Relations Administrative Policy #4.03.100, Section 6, Paragraph 1, a Petition for Recognition is <br />required along with written proof that 45% of the 33 employees are in agreement with the unit <br />modification. <br />On June 11, 2003, an election was held with the majority of the employees selecting IBEW as their <br />representative. <br />On June 23, 2003, the SBPEA filed an appeal pursuant to Administrative Policy #4.03.100, Section <br />6, Paragraph 1, Subsection F seeking to set aside the results of the election. The appeal <br />procedure requires the Municipal Employee Relations Officer (City Manager) to make findings of <br />fact and report these to the Honorable Mayor and City Council, who may adopt, reverse, or modify <br />the determination, and the Municipal Employee Relations Officer must follow the decision of the <br />City Council. <br />DISCUSSION/ANALYSIS: <br />The 33 affected employees have a desire and interest to be represented by IBEW. They initiated <br />the petition and complied with the Employer -Employee Relations Administrative Policy. IBEW <br />already represents a group of employees in the Electric Department. The group of employees <br />seeking IBEW representation will be the first employees outside of the Electric Department to be <br />represented by an organization other than the SBPEA. <br />The Water/Wastewater employees seeking the unit modification identify themselves as having <br />similar interests as those employees already represented by IBEW. The affected employees <br />perform specialized tasks, as do the electricians who are already members of IBEW. In addition, <br />IBEW represents employees working in various utilities departments in other agencies. As such, <br />the 33 employees in the Water/Wastewater Department associate themselves more so with IBEW <br />than the SBPEA. <br />
