CITY OF COLTON <br />INTEROFFICE MEMORANDUM <br />TO: Honorable Mayor and City CouncilmemberS <br />Tom Ramsey, SBPEA Field Services Representative <br />Stan Stosel, IBEW Labor Representative <br />Olivia Flores, Deputy City Clerk <br />FROM: Daryl Parrish, City Manager <br />CC: Eric Fraser, Water/Wastewater Director <br />SUBJECT: Unit Modification <br />DATE: July 15, 2003 <br />INTRODUCTION <br />On June 23, 2003, the San Bernardino Public Employees Association ("SBPEA") <br />filed an appeal to the City Council pursuant to Administrative Policy 4.03.100, Section 6, Rule 1, <br />Subsection F, seeking to set aside the results of an election conducted on June 11, 2003, to <br />determine whether certain City employees desired to be represented by the International <br />Brotherhood of Electrical Workers, Local 47 ("IBEW") or the SBPEA. <br />The appeal procedure requires the Municipal Employee Relations Officer to make <br />findings of fact and report to the City Council within thirty days following the date of the appeal. <br />The City Council may then adopt, reverse or modify the determination, and the Municipal <br />Employee Relations Officer must then follow the decision of the City Council. <br />FINDINGS OF FACT <br />On November 27, 2002, IBEW Local 47 submitted a Petition for Modification <br />requesting that employees in the following classifications currently represented in the General <br />Unit by the San Bernardino Public Employees Association ("SBPEA") be included in the same <br />bargaining unit as other employees represented by IBEW: <br />Collection System Maintenance Worker -in -Training, Collection <br />System Maintenance Worker I, Collection System Maintenance <br />Worker II, Environment Compliance Technician, Environment <br />Compliance Inspector, Lead Water Utilities Operator, Lead Waste <br />Water Utilities Operator, Utilities Inspector, Wastewater <br />Fundings of Fact -Appeal 071503 <br />
