CITY OF COLTON <br />AGENDA REPORT <br />FOR COUNCIL MEETING OF DECEMBER 16, 2003 <br />TO: HONORABLE MAYOR AND CITY COUNCIL <br />FROM: ERIC FRASER, WASTEWATER DIRECTOR <br />Item #13 <br />SUBJECT: AGREEMENT IN CONCEPT FOR RESERVATION OF <br />WASTEWATER CAPACITY WITH RIVERSIDE COUNTY <br />SERVICE AREA 152-C <br />DATE: <br />BACKGROUND: <br />December 9, 2003 <br />Recently, the City Council authorized staff to seek an opinion from San Bernardino and <br />Riverside County LAFCO's to determine whether an agreement to accept for treatment <br />wastewater from the unincorporated Highgrove area, including the proposed Spring <br />Mountain Ranch Development project, is exempt from LAFCO jurisdiction. San <br />Bernardino LAFCO has determined that it is exempt. We understand that Riverside <br />County LAFCO will be acting on that request shortly. In the meantime, the developer of <br />the project, Eastbridge Partners, has prepared the attached agreement in an attempt to <br />secure agreement on wastewater treatment for the potential 5,500± residential units that <br />could be built in the Highgrove area. <br />DISCUSSION/ANALYSIS: <br />The agreement proposes a wastewater treatment service contract between the City of <br />Colton and Riverside County CSA 152-C for the dedication and reservation of wastewater <br />treatment capacity in the City's Wastewater Treatment Plant and facilities. The <br />agreement proposes to reserve sufficient capacity to accommodate approximately 5,500 <br />residential units (The developer's project consists of 2,435± residential units.) The <br />agreement provide for the following: <br />1. City agrees to reserve wastewater treatment capacity to accommodate 5,500 <br />dwelling units. <br />2. CSA 152-C agrees to construct and operate the wastewater distribution system <br />that will connect to the City's wastewater treatment plan. <br />3. CSA 152-•C will pay the City $2,800 per connection based upon a schedule of <br />connections that culminates in the City receiving $6,818,000 before December of 2008. <br />4. City agrees to cap the $2,800 per connection fee for a period of 10 years and the <br />City cannot charge any other fees except for the monthly service charge imposed on <br />wastewater customers. <br />5. The agreement will be perpetual, such that it will not expire, terminate or cancel, <br />except by mutual consent of the parties. <br />
