CONTRACT FOR DESIGN-BUILD CITY OF COLTON RECLAMATION OF AQUIFER SUPPLY PROJECT 1. PARTIES AND DATE APPROVED BY CITY O NCIL Date � �Q3 Item # This Contract for Design-Build ("Contract") is made and entered into this 12�` day of �� , 2003 by and between the City of Colton, a municipal corporation ("Owner") and US Filter/Ionpure, Inc., a corporation duly authorized to conduct business in the State of California. ("Contractor"). 2. RECITALS 2.1 Owner is a municipal corporation organized under the laws oF the State of Califomia, with power to contract for services necessary to achieve its purpose. 2.2 Contractor is a professional contractor, experienced in providing services far the design and construction of the City of Colton Reclamation of Aquifer Supply Project ("ProjecY') which includes, without limitation, the design and installation of a Perchlorate Ion Exchange System ("IES") for the treatment of the City of Colton Wells Nos. 15, 17 and 24, as further provided in this Contract, and is familiar with the plans of the Owner. 2.3 Owner desires to engage Contractor to perform the Project as set forth herein. 2.4 Contractor obtains and delivers in accordance with this Agreemeent, the Performance Bond, Payment Bond, insurance documents and the other applicable certifications as required by this Contract. 3. TEanTs 3.1 Incorooration of Documents. This Contract includes and hereby incorporates in full the following documents, including all exhibits, drawings, specifications and documents therein, and schedules, attachments and addenda thereto: Exhibit A, Plans and Specifications Exhibit B, General Conditions Exhibit C, Price Schedule and Responsibilities Exhibit D, Certifications Attachment 1, Certification Labor Code — Section 1861 Attachment 2, Nondiscrimination Clause Attachment 3, Drug-Free Workplace Certification (e) Exhibit E, Performance Bond, Payment Bond, Notice to Proceed.
