CUA-2003-01 A RESOLUTION OF THE COLTON UTILITY AUTHORITY OF THE CITY OF COLTON RATIFYING THE CITY MANAGER'S DECLARATION OF AN EMERGENCY AND THE ACTIONS HE DEEMED NECESSARY TO INSTALL WELLHEAD TREATMENT AT WELL NOS. 15, 17 AND 24 WHEREAS, Section 22050 of the State Public Contract Code govems emergency contracting procedures applicable to the City of Colton; and WHEREAS, Section 22050 of the Public Contract Code allows the Colton Utility Authority to pass a resolution by a four-fifths vote of its membership declaring that (a) emergency conditions that exist that do not permit a delay resulting from a competitive solicitation for bids; and (b) the repairs are necessary to respond to the emergency; and WHEREAS, the Colton Utility Authority finds, based upon the Staff Report and other infortnation in the record, that emergency conditions exist at Well Nos. 15, 17 and 24, which meet the requirements of Section 22050, and that the City Manager shall take appropriate action to respond to such emergency. NOW, THEREFORE, BE IT RESOLVED that the Colton Utility Authority resolves as follows: 1. The City Council hereby authorizes the City Manager to take immediate action to order materials and labor, in an amount not to exceed $825,000, to install wellhead treatment at Well Nos. 15, 17, and 24 to remove perchlorate from the water produced by those sources of supply, pursuant to Section 22050 of the Public Contract Code, to respond to the stated emergency.
