WHEREAS, pursuant to Health and Safety Code Section 33333.3, the Agency is responsible for preparation and certification of an Environmental Impact Report ("EIR"), Linder CEQA, regarding the adoption of the Redevelopment Plan; and WHEREAS. in accordance with Health and Safety Code Section 33357, the Agency will be the public entity to act first in approving the Redevelopment Plan; and WHEREAS, the Agency is the "lead agency" for preparation and certification of an EIR regarding the proposed Redevelopment Plan (Public Resources Code Section 21067 and Title 14 California Code of Regulations Sections 15050 and 1505 1); NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE REDEVELOPMENT AGENCY FOR THE CITY OF COLTON, AS FOLLOWS: Section 1. On July 1, 2003, the governing body of the Agency conducted a full and fair joint public hearing with the City Council of the City of Colton and considered the Final Environmental Impact Report for the proposed Redevelopment Plan for the La Cadena Corridor Redevelopment Project Area (State Clearinghouse Number 2003031017) prepared by GRC Associates, Inc., of Brea, California. for the Redevelopment Agency for the City of Colton, dated April 2003, and the comments and responses thereto (the "Final FIR"), assessing the potentially significant environmental impacts from the adoption of the Redevelopment Plan. The Final EIR is a -'Program EIR" Linder CEQA. The minutes of the Agency Secretary for the July 1, 2003, joint public hearing of the governing body of the Agency shall include a record of all communication and testimony submitted to the governing body of the Agency by interested persons at the joint public hearing regarding the Final FIR and the Redevelopment Plan. Section 2. Prior to the opening of the public hearing at which this Resolution is adopted, the governing body of the Agency received the Final EIR and independently reviewed and considered the information contained in the Final FIR. In the independent discretion of the goveming body of the Agency, the governing body of the Agency finds and determines that the Final FIR was prepared in compliance with CEQA, adequately describes the activities likely to 48 16-6214-9632.1
