to each resident and business within the Redevelopment Project Area, not less than thirty (30) <br />days prior to the date of the Joint Hearing; and <br />WHEREAS, each assessee in the Redevelopment Project Area whose property could <br />potentially be subject to acquisition by condemnation or exercise of the power of eminent <br />domain under the provisions of the Redevelopment Plan was so informed by express language in <br />the notice sent by mail to such persons as part of the notice of the Joint Public Hearing, and such <br />mailed notice included a map of the Project Area and information as to how such person could <br />obtain a copy of the legal description of the Project Area free of charge; and <br />WHEREAS, copies of the notice of the Joint Public Hearing were mailed by certified <br />mail with return receipt requested to the governing body of each affected taxing agency which <br />receives taxes from property within the Project Area; and <br />WHEREAS, the City Council has considered the report and finding of the Planning <br />Commission, the Report, the Redevelopment Plan and its economic feasibility, and the Final <br />Program EIR the written materials and testimony of the City and Agency staff presented at the <br />Joint Public Hearing, and the City Council has provided a full and fair opportunity for all persons <br />to speak and present testimony at the Joint Public Hearing, and has received and considered all <br />evidence and testimony presented for or against any and all aspects of the Redevelopment Plan <br />and has directed that written findings in response to each written objection of an affected <br />property owner and affected taxing entity filed with the City Clerk, if any, before the hour set for <br />the Joint Hearing be considered and approved by the City Council prior to the adoption of this <br />Ordinance by the City Council at the second reading thereof, and <br />WHEREAS, the Redevelopment Plan is consistent with all applicable provisions of the <br />CRL, CEQA, the and all other laws and ordinances of the City; and <br />WHEREAS, the Redevelopment Plan establishes a flexible framework for undertaking <br />the redevelopment, rehabilitation and revitalization of the Project Area and for the prevention <br />and elimination of the spread of blight from the Project Area. <br />4811-9251-8626.1 5 <br />
