Zamora, Community Development Director <br />SUBJECT: Approval to Amend Professional Services Agreement with Michael <br />Brandman Associates (MBA) to Provide Professional Environmental <br />Services/CEQA Processing for the Pacific Rail Industries Rail <br />Dismantling and Salvage Operations Facility <br />DATE: May 22, 2003 <br />BACKGROUND: <br />On September 3, 2002, the City Council approved a Professional Services Agreement with Michael <br />Brandman Associates (MBA) in the amount of $75,633 for the preparation of an Environmental <br />Impact Report (EIR), for the Pacific Rail Industries Rail Dismantling And Salvage Operations <br />Facility, located at 785 East "M" Street. In 1986, Pacific Rail Industries received approval of a <br />Conditional Use Permit (CUP), File Index Number #C-5-86, to operate a rail dismantling and <br />salvage operations facility. <br />On June 19, 2001, Pacific Rail Industries submitted an application to modify their existing CUP to <br />allow the installation of a steel shredder. The proposed modifications to their CUP require an EIR, <br />which is currently being prepared by MBA. Subsequent to Council's approval, there have been <br />three (3) budget augments to the contract, increasing the total contract amount to $82,562. All costs <br />for the project are paid by Pacific Rail Industries. There is no cost or fiscal impact to the City. <br />The applicant is requesting that two additional amendments be added to their modified Conditional <br />Use Permit: (1) transloading services and activities: currently the Union Pacific Railroad is <br />conducting transloading activities on the site, and (2) to allow an increase in the amount of material <br />that may be stored overnight: the applicant is currently limited to overnight storage of material <br />produced by two rail cars. <br />Since the two (2) additional amendments will result in substantial revisions to the Administrative <br />Draft of the FIR currently in progress, an Amendment to the existing Agreement's Scope of Work <br />and a Budget Augment in the amount of $45,842 is required in order to proceed with the applicant's <br />request. <br />ANALYSIS/DISCUSSION: <br />Staff has worked with the Consultant and the applicant to assess the expansion of the project and <br />the approach to use in assessing environmental impacts related to the new activities that will be <br />
