The new activities represent a broadening of the scale of the project and <br />require additional impact assessments in the Environmental Impact Report. Additions to the Scope <br />of Work will include the preparation of additional air quality/air toxics analysis, revisions to the <br />Phase I ESA, an expansion of EIR sections and technical documents, the preparation and <br />distribution of a revised Notice of Preparation (NOP), revisions to the Administrative Draft EIR, <br />and an increase to other administrative, clerical and project management costs that were part of the <br />original Agreement. The applicant will pay for the increase to the contract. <br />ALTERNATIVES: <br />Reject the applicant's request to add two amendments to the CUP and to revise the EIR currently <br />being processed for the revised project. However, such an action would likely mean that the <br />applicant would prepare additional environmental analysis and the consultants used would not be <br />working under the direction nor review of the City. <br />FISCAL IMPACT: <br />There is no cost to the City. The applicant (Pacific Rail Industries) will pay for all work required by <br />the consultant for the proposal. <br />ENVIRONMENTAL IMPACT: <br />The consultant is currently preparing an Environmental Impact Report for the proposed <br />modifications to the CUP. <br />RECOMMENDATION: <br />Staff recommends that the City Council approve an Amendment in the amount of $45,842 to the <br />Professional Services Agreement with Michael Brandman Associates for the Pacific Rail hidustries <br />project, and authorize the City Manager to execute the Amendment on behalf of the City. <br />Attachment: Michael Brandman Associates Professional Services Agreement Amendment <br />Attorney: 1— - <br />Manager: <br />Finance Director: <br />OTHER: <br />
