Subject: Adoption of Resolution and Purchasing Ordinance <br />June 17, 2003 <br />Page 3 <br />EXCEPTIONS TO COMPETITIVE BIDDING: <br />The proposed ordinance also provides that competitive bidding, either formal or informal, <br />for public and non-public projects is not required under certain conditions. Those <br />conditions include: <br />— Emergencies as determined by the City Manager <br />— No competitive market exists <br />— No bids are received <br />For non-public projects, exceptions for competitive bidding also include: <br />— Competitive bidding was already completed by another public agency <br />— Purchases made by the State Department of General Services on behalf of <br />the City <br />— Purpose of bidding is otherwise accomplished <br />— Purchase of electric energy <br />As explained above, the proposed ordinance will improve efficiency in the City's purchasing <br />and bidding procedures. Therefore staff recommends that the City Council adopt the <br />proposed resolution and approve first reading of an ordinance to implement the procedures <br />in the UPCCA. <br />ALTERNATIVES: <br />Deny approval of the proposed ordinance and continue utilizing the existing <br />purchasing system. <br />2. Direct staff to revise the proposed ordinance and provide specific instructions for <br />such revisions. <br />FINANCIAL IMPACT: <br />Although it is difficult to specify the exact cost savings of approving the proposed <br />ordinance, it is certain that the proposed changes to the City's bidding and purchasing <br />system will increase efficiency and create savings in terms of staff time and paperwork. In <br />addition, the use of paper and supplies would decrease as a result of not bidding all of the <br />projects and contracts currently subject to bidding under State law and the City's existing <br />purchasing rules.
