FRASER, DIRECTOR OF WATER AND WASTEWATER <br />OPERATIONS <br />SUBJECT: AWARD OF CONTRACT TO KENNEDY/JENKS IN THE NOT -TO -EXCEED <br />AMOUNT OF $12,500 FOR THE ANNUAL UPDATE OF THE STORMWATER <br />ASSESSMENT <br />DATE: June 4, 2003 <br />BACKGROUND <br />In October, 1990 the County of San Bernardino Flood Control District was issued a five-year <br />NPDES Stormwater Permit, with 16 incorporated cities as co -permittees. On October 4, 1994, <br />Council approved the City's participation in a County -wide NPDES Stormwater Assessment. <br />Another five-year permit took effect in October, 2000. <br />The City Council decided at its June 4, 1996 meeting to pursue a City NPDES Stormwater Rate <br />to be placed on the FY96-97 County Tax Rolls, and authorized Kennedy -Jenks Consultants to <br />prepare the Basic Fee. At the July 2, 1996 Council meeting, Council approved an Ordinance <br />Amending Chapter 14.01 of the Colton Municipal Code to provide for a Stormwater <br />Management Charge. Each year, the cost to the City's residential and commercial landowners <br />remains the same as previous years, only those parcels for which the land use has changed <br />(i.e., vacant to developed) are charged accordingly, thus complying with Proposition 218 <br />requirements. <br />DISCUSSION/ANALYSIS <br />Each year, the City of Colton is required to amend the Stormwater Management Charge in <br />order to include parcels previously absent in land -use definitions that are now present in the <br />City; to have the information updated; and, and then to hold public hearings on the proposed <br />charges. Section 3.08.060 of the Colton Municipal Code provides that the City Council may, by <br />majority vote, dispense with bidding in any circumstance where it would be impracticable, <br />useless or uneconomical to follow such procedures and that the public welfare would be best <br />served by dispensing with it. <br />Since the parcel information had been developed by Kennedy -Jenks Consultants, they have <br />been authorized each year to prepare the required Stormwater Management Charge Report <br />because of the cost -savings realized each year. If not handled in this manner, we would have <br />to pay a different consultant additional fees to develop a new land use data program each year. <br />City staff is unable to prepare the data required by the Tax Collector's Office, therefore, it is <br />recommended that Kennedy -Jenks Consultants be authorized to prepare the FY03-04 <br />Management Parcel Charges for the Stormwater program. <br />Page 1 of 2 (w/Agreement) <br />
