Neither Kenneth <br />S. Schiller nor the City of Colton has applied to the worker's Compensation Appeals Board <br />for a determination pursuant to Section 21025 whether such disability is industrial; and, <br />BE IT FURTHER RESOLVED that the member was separated from his employment <br />in the position of Police Detective after expiration of his leave rights under Section 21025.4 <br />of the Government Code, wherein his last work day on paid status was December 27, 2002, <br />and that no dispute as to the expiration of such leave rights is pending; and, <br />BE IT FURTHER RESOLVED that the primary disabling condition was fatal. The <br />member's spouse is competent and authorized to act on decedent's behalf in legally <br />binding retirement matters. <br />PASSED, APPROVED and ADOPTED this 18th day of March 2003. <br />ATTEST: <br />CAROLINA P.
