R-16-03 <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />COLTON, CALIFORNIA, PURSUANT TO GOVERNMENT CODE <br />SECTION 21025, MAKING DETERMINATION OF DISABILITY <br />STATUS FOR LOCAL SAFETY EMPLOYEE KENNETH SCOTT <br />SCHILLER <br />WHEREAS, THE City of Colton (hereinafter referred to as Agency) is a <br />contracting agency of the Public Employees' Retirement System; and <br />WHEREAS, The Public Employees' Retirement Law requires that a <br />contracting agency determine whether an employee of such agency is in <br />employment in which he is classified as a local safety member; is disabled <br />for purposes of Public Employees' Retirement Law; and, whether such <br />disability is "industrial" within the meaning of such law; and <br />WHEREAS, the City Council confirms that a worker's Compensation <br />Claim was filed by Kenneth Scott Schiller alleging disability from his <br />position as Police Detective and that a settlement agreement has been <br />entered into by the interested parties; and, <br />WHEREAS, the City Council has reviewed the medical and other <br />evidence relevant to such alleged disability. <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />The City of Colton hereby finds and determines that Kenneth S. <br />Schiller was rendered incapacitated within the meaning of the Public <br />Employees' Retirement Law for performance of his duties in the position of <br />Police Detective, that the disability was the result of illness or <br />disease, specifically, metastatic esophageal cancer, under the provisions <br />of Government Code Section 21156; and, <br />BE IT FURTHER RESOLVED that the City Council finds and determines <br />that Kenneth S. Schiller was incapacitated within the meaning of the <br />Public Employees' Retirement Law for performance of his duties in the <br />
