Zamora, Community Development Director <br />SUBJECT: Consideration of an Ordinance approving Amendments to Sections <br />18.20.120(A)(3)1 18.22.120(A)(4), 18.24.120(A)(5), 18.26.120(A)(6), <br />18.28.120(A)(6) & 18.54.020(A)(1) of the Colton Municipal Code relating to the <br />parking requirements for eating and drinking establishments and the keeping of <br />animals on estate residential and industrial properties: File Index No. DAP -000- <br />239 & DAP -000-240 <br />DATE: April 7, 2004 <br />BACKGROUND: <br />On March 23, 2004 the City Planning Commission approved Resolution Number R-06-04 and <br />recommended that the City Council approve File Index Numbers DAP -000-239 and DAP -000-240, <br />Zoning Ordinance Text Amendments pertaining to Section 18.54.020 (A)(1), Section 18.20.120 (A)(3), <br />Section 18.22.120 (A)(4), Section 18.26.120 (A)(6) and Section 18.28.100 of Title 18 of the Colton <br />Municipal Code (Zoning Ordinance). <br />ANALYSIS/DISCUSSION: <br />The Text Amendment for File Index Number DAP -000-239 proposes to amend Section 18.54.020 (A)(1). <br />This Amendment is recommended to provide greater flexibility to property owners of large properties <br />who wish to keep livestock, such as horses and cattle, and comply with all other requirements for animal <br />keeping established by this ordinance section. Staff is requesting approval to amend the Section to read <br />"in an R -E (Residential Estate), M-1 or M-2 zone to keep a total combination thereof of three or less <br />animals per acre, and providing all of them are kept at least sixty feet from any surrounding residence and <br />forty feet from the residence of the property in which they are kept." <br />The Text Amendment for File Index Number DAP -000-240 proposes to amend ordinance sections <br />18.20.120 (A)(3), 18.22.120 (A)(4), 18.24.120 (A)(5)9 18.26.120 (A)(6)5 and 18.28.120 (A)(6) pertaining <br />to off-street parking requirements for eating and drinking establishments, including fast food and drive- <br />through restaurants. The Ordinance Sections shall be amended from one parking space for every 50 <br />square feet of gross floor area to read "for eating and drinking establishments, including fast food and <br />drive-through establishments, one parking space shall be provided for every 100 square feet of gross floor <br />area, with a minimum of five spaces." <br />This Text Amendment is recommended in order to provide more reasonable and flexible off-street <br />parking requirements for restaurant establishments based on the typical daily parking needs of such <br />businesses. <br />
